Minutes for Approval

Ron DeBaecke made a motion to approve the January 25, 2023 Minutes. Motion seconded by Greg Grauer. Jack Smylie abstained. All others in attendance in favor.

RESOLUTION OF THE JOINT LAND USE BOARD

OF THE TOWNSHIP OF NORTH HANOVER

MEMORIALIZING MASTER PLAN

CONSISTENCY REVIEW DETERMINATION

ON TOWNSHIP ORDINANCE 2023-01


WHEREAS, the North Hanover Township Committee (“Committee”) referred Ordinance 2023-01 to the North Hanover Township Joint Land Use Board (“Board”) for the purposes of Master Plan consistency review in accord with N.J.S.A. 40:12A-8.; and


WHEREAS, Ordinance 2023-01 is titled “AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER ADOPTING REDEVELOPMENT PLAN FOR BLOCK 602, LOT 9.02, NORTH HANOVER TOWNSHIP, BURLINGTON COUNTY, NEW JERSEY”; and


WHEREAS, the Board reviewed the matter at its January 25, 2023, meeting finding that the Ordinance was not inconsistent with the Master Plan; and


NOW, THEREFORE, BE IT RESOLVED by the Joint Land Use Board of the Township of North Hanover as follows:


1. CONSISTENCY HEARING ON ORDINANCE 2023-1. The Board at its regular meeting on January 25, 2023, the Board heard a presentation from and reviewed the report of Edward Fox, AICP, PP, of Environmental Resolutions, Inc. and afforded the public with an opportunity to make comments and questions concerning the Ordinance and Redevelopment Plan;


2. FINDINGS AND CONCLUSIONS. The Board, following the presentation from Edward Fox and an opportunity for public comment, finds that the Ordinance and Redevelopment Plan is not inconsistent with the Master Plan of the Township of North Hanover;

3. RECOMMENDATIONS. The Board resolves that the Ordinance and Redevelopment Plan, as considered by the Board at its January 25, 2023 hearing, and after the presentation by Edward Fox, and the opportunity for public comment be ADOPTED by the Township Committee with the following recommendation that a condition of the any redevelopment agreement or otherwise through the redevelopment process be that when the developer seeks approvals related to this project, the developer shall provide individual notices to each of the residents of Spartan Village, a manufactured home community located immediately to the south of Block 602, Lot 9.02;


4. SEVERABILITY. If any part of this Resolution shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this Resolution;


5. AVAILABILITY OF THIS RESOLUTION. A copy of this Resolution shall be available for public inspection at the Office of the Joint Land Use Board of the Township of North Hanover;


6. EFFECTIVE DATE. This Resolution shall take effect immediately.

Tom Kimball made a motion to memorialize Resolution 2023-07. Motion Seconded by Greg Grauer. All in Favor.



Review of Resolution TC2023-44- Resolution Authorizing Joint Land Use Board to Undertake Preliminary Investigation to Determine Whether Certain Properties Qualify for Designation as Non-Condemnation Area in Need Of Redevelopment Pursuant NJSA 40A:12A-1ET SEQ


Attorney for the the North Hanover Land Use Board Stephen Raymond. Reviewed the process with the Land Use Board on starting a redevelopment study. Mr. Raymond stated the board planner will study whether the properties fall under one of the 7 reasons stated in Municipal Land Use Law and compile a report. The board will then determine if the area is in need of redevelopment. When the report is complete we will have a public hearing.

Board member DeBaecke, gave a description of the properties, stating both properties are very overgrown and vacant.

Mr. Raymond stated that there is no action the board has to take at this time. If the are is found the to be in need of redevelopment, the Township Committee would develop a redevelopment plan and the land use board would review that plan for conformance with the master plan.

Chairman Tom Kimball opened the floor to public comment. Being no public in attendance Ron DeBaecke made a motion to close public comment. Motion was seconded by Greg Grauer ; all in favor.
