Review of Ordinance TC2023-02- Ordinance Amending Chapter 15, Land Subdivision and Site Plan Review, of the Code of the Township of North Hanover, County of Burlington State of New


Attorney Stephen Raymond reviewed the proposed Ordinance. The Board discussed that the portion of the town in the Pinelands Commission Jurisdiction is Falcon Courts North and Endeavor School where we have limited jurisdiction. Mr. Raymond stated that the Pineland Commission only allows the Township to change the fine amount and number of copies of the plan to be submitted from their sample ordinance.


Chairman Tom Kimball opened the floor to public comment. Tom Desimpel of 886 Provinceline Road, asked where in town is included in Pinelands Reserve. Mr. DeBaecke stated it is just the portion within United Communities. Mr. Desimpel asked where he could find the chapter that is being amended. The board secretary stated she wasn’t sure if the Land Use Chapter of the zoning ordinance is on the website, but she could make a copy if not.

Ron DeBaecke made a motion to close public comment, motion seconded by Tom Kimball. All in favor.

Ron DeBaecke made a motion to find the ordinance not inconsistent with the Master Plan for North Hanover Township.

RESOLUTION NO. 2023-08

RESOLUTION OF THE JOINT LAND USE BOARD

OF THE TOWNSHIP OF NORTH HANOVER

MEMORIALIZING MASTER PLAN

CONSISTENCY REVIEW DETERMINATION

ON TOWNSHIP ORDINANCE 2023-02


WHEREAS, the North Hanover Township Committee (“Committee”) referred Ordinance 2023-02 to the North Hanover Township Joint Land Use Board (“Board”) for the purposes of Master Plan consistency review in accord with N.J.S.A. 40:12A-8.; and

WHEREAS, Ordinance 2023-02 is titled “AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER AMENDING CHAPTER 15, LAND SUBDIVISION AND SITE PLAN REVIEW, OF CODE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON AND STATE OF NEW JERSEY”; and

WHEREAS, the Board reviewed the matter at its March 22, 2023, meeting finding that the Ordinance was not inconsistent with the Master Plan; and


NOW, THEREFORE, BE IT RESOLVED by the Joint Land Use Board of the Township of North Hanover as follows:

1. CONSISTENCY HEARING ON ORDINANCE 2023-2. The Board at its regular meeting on March 22, 2023, the Board considered Ordinance 2023-2 and afforded the public with an opportunity to make comments and questions concerning the Ordinance;

2. FINDINGS AND CONCLUSIONS. The Board, after considering the Ordinance and any public comment, finds that Ordinance 2023-2 is not inconsistent with the Master Plan of the Township of North Hanover;

3. RECOMMENDATIONS. After its March 22, 2023 hearing and having given the opportunity for public comment and the Board having considered public comment, if any, the Board hereby resolves that Ordinance 2023-2, be ADOPTED by the Township Committee.

4. SEVERABILITY. If any part of this Resolution shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this Resolution;

5. AVAILABILITY OF THIS RESOLUTION. A copy of this Resolution shall be available for public inspection at the Office of the Joint Land Use Board of the Township of North Hanover;

6. EFFECTIVE DATE. This Resolution shall take effect immediately.

Public Comment

Chairman Tom Kimball opened the floor to public comment. Tom Desimpel of 886 Provinceline Road asked if there were any updates on the 37 houses on Provinceline Road. Board Secretary stated that they have not received any updates, and there are outside approvals that are still required.

Board Discussion

Applicant is asking if they can do 25% intervals of their escrow for their application. Mr. Raymond stated the board can decided on the amount and threshold of replenishment. Board Secretary and Board member Joe Greene also the Township Treasurer stated that they felt in their experience given the extensiveness of the application that 50% would be best. The board discussed 50% of escrow with 20% replenish threshold. Board Member Debbie Kucowski asked if this would set a president. Stephen Raymond Board Attorney stated no, it does not set a president.

Motion to allow applicant to provide 50% of the required escrow with a replenish threshold of 20%.
