Mayor DeLorenzo reduced the bill list by $1,456.43 on purchase order 17-00321 and gave an

explanation. There was a general consensus of the Township Committee to reduce the bill list by

the stated amount.

ORDINANCE – ADOPTION

2017-02 Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish

a Cap Bank Pursuant to N.J.S.A. 40A:4-45.14

TOWNSHIP OF NORTH HANOVER

CALENDAR YEAR 2017

ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS

AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14)

WHEREAS, the Local Government CAP Law, N.J.S. 40A:4-45.1 et seq., provides that in

the preparation of its annual budget, a municipality shall limit any increase in said budget to

0.05% unless authorized by ordinance to increase it to 3.5% over the previous year’s final

appropriations, subject to certain exceptions; and

WHEREAS, N.J.S.A.40A: 4-45.15a provides that a municipality may, when authorized

by ordinance, appropriate the difference between the amount of its actual final appropriation and

the 0.00% percentage rate as an exception to its final appropriations in either of the next two

succeeding years; and

WHEREAS, the Township Committee of the Township of North Hanover in the County

of Burlington finds it advisable and necessary to increase its CY2017 budget by up to 3.5% over

the previous years final appropriations, in the interest of promoting the health, safety and welfare

of the citizens; and

WHEREAS, the Township Committee of the Township of North Hanover in the County

of Burlington hereby determines that a 3.00% increase in the budget for said year, amounting to

$74,115.10 in excess of the increase in final appropriations otherwise permitted by the Local

Government CAP Law, is advisable and necessary; and,

WHEREAS, the Township Committee of the Township North Hanover of in the County

of Burlington hereby determines that any amount authorized herein above that is not

appropriated as part of the final budget shall be retained as an exception to final appropriation in

either of the next two succeeding years.

NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township

of North Hanover in the County of Burlington, a majority of the full authorized membership of

this governing body affirmatively concurring, that, in the CY 2017 budget year, the final

appropriations of the Township of North Hanover shall, in accordance with this ordinance and

NJ.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $84,467.62 , and that the CY 2017

municipal budget for the Township of North Hanover be approved and adopted in accordance

with this ordinance; and

BE IT FURTHER ORDAINED, that any amount authorized herein above that is not

appropriated as part of the final budget shall be retained as an exception to final appropriation in

either of the next two succeeding years; and

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be

filed with the Director of the Division of Local Government Services within 5 days of

introduction; and

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption,

with the recorded vote included thereon, be filed with said Director within 5 days after such

adoption.

MAYOR OPENS THE MEETING TO THE PUBLIC

Mr. Ralph Ruocco – 101 Chesterfield-Arneytown Road – He stated he is under the impression

this is procedural. He expressed concern this would give cart blanche at a later date. Attorney

Roselli gave an explanation. Mayor DeLorenzo noted this would only be used should it be

needed and it was a safe guard for the Municipality. Committeeman O’Donnell also explained

the banking process. Deputy Mayor DeBaecke noted this was safeguarding against an unknown

emergency and feels it is wrong to raise taxes just because you can.

2017-79 Resolution Authorizing the Preparation of Estimated Tax Bills for the Year of

2017

COUNTY OF BURLINGTON

A RESOLUTION AUTHORIZING THE PREPARATION OF ESTIMATED TAX BILLS

FOR THE YEAR OF 2017

WHEREAS, the Division of Local Government Services, State of New Jersey has the authority by State

Statue to examine, review and then certify all local government budgets to the County Board of Taxation

for the purpose of real estate taxation, and

WHEREAS, the Burlington County Board of Taxation has not yet received certification of the North

Hanover Township’s budget and cannot strike a tax rate until such certification is received from the State

of New Jersey and will therefore cause the delay in receiving state funding, and

WHEREAS, the Township Committee has determined that there will be insufficient cash flow to support

operations in August 2017 unless third quarter revenue is received on time, and

WHEREAS, the Tax Collector and the Chief Financial Officer have reviewed and computed an

estimated tax levy in accordance with N.J.S.A. 54:4-66.3,

NOW THEREFORE, BE IT RESOLVED, that the Township Committee of the North Hanover

Township, County of Burlington, State of New Jersey, hereby authorized that:

1. The Tax Collector is directed to prepare and issue estimated tax bills

for the Municipality of North Hanover Township for the third quarter

2016, in accordance with the provisions of N.J.S.A. 54:4-66.2et seq.

2. The entire estimated tax levy for 2017 is hereby set at $9,254,628.46

3. The Tax Collector takes any additional steps necessary to immediately

implement this resolution.

BE IT FURTHER RESOLVED, that the Municipal Clerk provides a certified copy of this resolution to

the Tax Collector.

2017-80 Resolution Appointing Recreation Advisory Committee Members

WHEREAS, N.J.S.A. Title 40 and Title 40A provide for the Appointment of Certain

Officers, Appointees, and Employees to be appointed in Township Positions to carry out the

lawful duties and responsibilities of the Township; and

WHEREAS, the Recreation Advisory Committee has vacancies created by resignations

of individuals or by term expirations; and

WHEREAS, it is the desire of the North Hanover Township Committee to fill the

vacancies

NOW THEREFORE BE IT RESOLVED, that the following Officers, Appointees, and

Employees are hereby appointed for their respective terms, as follows:

2017-81 Resolution Authorizing Agreement between Township of North Hanover and

North Hanover Township School District to Jointly Provide a Summer Recreation

Program

AUTHORIZING AGREEMENT BETWEEN TOWNSHIP OF NORTH HANOVER AND NORTH

HANOVER TOWNSHIP SCHOOL DISTRICT TO JOINTLY PROVIDE A SUMMER

RECREATION PROGRAM

WHEREAS, an agreement has been made between the Township of North Hanover and

the North Hanover Township School District to jointly provide a Summer Recreation Program;

and

WHEREAS it is in the best interest of the Township and the District to jointly sponsor

and provide a summer recreation program for the children of the North Hanover Township

Schools and the Community.

NOW THEREFORE BE IT AGREED as follows:

The Township shall hire and compensate the necessary staff including, at a minimum, a

Director, Aides/Assistants, and a Nurse.

The Township shall contract with the District for the provisions of busses and drivers for

local field trips as per schedule provided by Director.

The Director, in coordination with the appropriate Township and District Officials, shall

design and develop a six (6) week summer program to be made available to the children

from June 26, 2017 through August 4, 2017.

The District shall notify the parents of the availability of the program and provide sites for

registration.

The Township shall conduct registrations and collect fees.

The Township shall order the necessary supplies utilizing, if desired, the contracts the

District has negotiated with various vendors.

The District shall pay the Township, upon receipt of the appropriate and fully executed

voucher, the amount of $5,200.00 subject to Board of Education approval.

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the

Township of North Hanover, County of Burlington, State of New Jersey, that the Mayor and

Municipal Clerk are hereby authorized to execute the agreement on behalf of the Township

Committee.

2017-82 Resolution Accepting the Proposal from Environmental Resolutions Inc.

Engineers for the Reconstruction of Provinceline Road.

RESOLUTION ACCEPTING THE PROPOSAL FROM ENVIRONMENTAL RESOLUTIONS

INC. ENGINEERS FOR RECONSTRUCTION OF PROVINCELINE ROAD

WHERAS, Environmental Resolutions Inc. has submitted a proposal dated April 13, 2017 for

engineering services for the Reconstruction of Provinceline Road; and

WHEREAS, it is the desire of the Township Committee to accept the proposal from

Environmental Resolutions Inc. Engineers for Improvements to Provinceline Road, in an amount not to

exceed $64,440.00; and

WHERAS, funds are available to accept said proposal, as evidenced by the attached Certification

of Availability of Funds;

NOW, THEREFORE, BE IT RESOLVED, by the Township of North Hanover that it does

hereby accept the proposal from Environmental Resolutions Inc. Engineers, in an amount not to exceed

$64,440.00 to provide engineering services for the Reconstruction of Provinceline Road – Base Plan,

Bid Documents and Construction Services.

DISCUSSION

There were no items up for discussion this evening.

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski noted the Easter Egg Hunt was well attended and nicely organized.

He also mentioned the Resolutions from the Bordentown Sewerage Authority with regards to the

pipeline.

Committeeman O’Donnell noted his participation in the Clean-Up Day in the Park.

Committeeman Doyle noted the Park Improvements look great.

Deputy Mayor DeBaecke noted the NJDOT projects bid were received an award would take

place May 4th. He also stated the lawn contractor has restarted mowing and that the park looks

great.

Mayor DeLorenzo noted he to when to the Park and it looks fabulous. He was grateful for the

grant monies.

Mayor DeLorenzo opened the meeting to the public.

Mr. Stanley Waszkiewicz – 145 Cookstown-New Egypt Road – He stated there is a missing stop

sign at the Cedar Grove Apartments. Mayor DeLorenzo noted this would be taken care of.

Mr. Wayne Voorhees inquired as to why there was a moment of silence. Committeeman

O’Donnell explained.

AUTHORIZING A CLOSED SESSION MEETING

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C.

404, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of North Hanover Township wishes to go into a

closed Executive Session and is of the opinion that such circumstances presently exist which

should not be discussed in public, and

WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.

10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case

for the purpose of the Township Committee to discuss contract negotiations, litigation and

personnel matters in this regard.

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover

Township that it will go into an Executive Session for the purpose of the Township Committee to

discuss 2015 Contract I Road Improvement Program Contract Matter, Professional Services

Contract Matter, Contract Matters, Litigation and Personnel matters.

BE IT FURTHER RESOLVED that the results of such discussion may be revealed at

such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are

formally settled. Interested parties may contact the Township Clerk anytime during normal

business hours for periodic updates as to the availability in this regard.
