ENGINEER’S REPORT

Engineer Hirsh reported there would be a change order to the Park contract for the relocation of

the Flag Pole. He stated it was complete and the projects should be done within the next two

weeks. He noted the NJDOT project bids would be received on April 19th.

APPROVAL OF BLUE LIGHT PERMIT APPLICATION

WHEREAS, pursuant to N.J.A.C. 13:24-5 ET Seq. an applicant for permit authorizing

the use of blue emergency warning lights may be considered eligible only if the applicant is an

active member in good standing of a volunteer fire company, first aid or rescue squad, or a

county or municipal Office of Emergency Management volunteer whose official duties include

responding to a fire or emergency call; and

WHEREAS, Renee Scarlata has met the qualification for a Blue Light Permit and it is

the recommendation of the Fire Chief to approve this applicant for a Blue Light Permit.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the

Township of North Hanover, County of Burlington, that in accordance with N.J.A.C. 13:24 et.

seq. it hereby approve Trevor Ingram for a Blue Light Permit and hereby authorizes the Mayor to

execute the Blue Light Permit Application.

BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the

Jacobstown Volunteer Fire Department Chief.

2017-69 Resolution Endorsing the Submission of the 2016 Recycling Tonnage Grant

Application

ENDORSING THE SUBMISSION OF THE 2016 RECYCLING

TONNAGE GRANT APPLICATION

WHEREAS, the Mandatory Source Separation and Recycling Act, P.L.1987, c.102, has

established a recycling fund from which tonnage grant may be made to municipalities in order to

encourage local source separation and recycling programs; and

WHEREAS, it is the intent and the spirit of the Mandatory Source Separation and Recycling Act

to use the tonnage grants to develop new municipal recycling programs and to continue and to expand

existing programs; and

WHEREAS, the New Jersey Department of Environmental Protection has promulgated recycling

regulations to Implement the Mandatory Source Separation and Recycling Act; and

WHEREAS, the recycling regulations impose on municipalities certain requirements as a

condition for applying for tonnage grants, including but not limited to, making and keeping accurate,

verifiable records of materials collected and claimed by the municipality; and

WHEREAS, a resolution authorizing this municipality to apply for the 2016 Recycling Tonnage

Grant will memorialize the commitment of this municipality to recycling and to indicate the assent of the

Township Committee of North Hanover Township to the efforts undertaken by the municipality and the

requirements contained in the Recycling Act and recycling regulations; and

WHEREAS, such a resolution should designate the individual authorized to ensure the

application is properly completed and timely filed.

NOW THEREFORE BE IT RESOLVED by the Township Committee of North Hanover

Township that North Hanover Township hereby endorses the submission of the recycling tonnage grant

application to the New Jersey Department of Environmental Protection and designates Mary Picariello of

North Hanover Township to ensure that the application is properly filed, and hereby appoints Christy

Osborne of Burlington Township as the Certified Recycling Coordinator to review and execute the 2016

Recycling Tonnage Report on behalf of North Hanover Township; and

BE IT FURTHER RESOLVED that the monies received from the recycling tonnage grant be

deposited in a dedicated recycling trust fund to be used solely for the purposes of recycling.

RESOLUTION AUTHORIZING THE ISSUANCE OF A DUPLICATE TAX SALE

CERTIFICATE PURUSUANT TO CHAPTER 99 OF THE PUBLIC LAWS OF 1997

WHEREAS, the Tax Collector of North Hanover Township has previously issued a tax sale

certificate to MTAG Cust for Empire VIII which certificate is dated October 6, 2016 covering

premises commonly known and referred to as Block 800 Lot 52.02 as set out on the municipal

tax map then in use which certificate bears number 16-00016.

WHEREAS, the purchaser of the aforesaid tax sale certificate has indicated to the Tax Collector

that they have lost or otherwise misplaced the original tax sale certificate and have duly filed the

appropriate Affidavit of Loss with the Tax Collector, a copy of which is attached hereto.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of North Hanover

Township that the Tax Collector of the Township North Hanover be and is hereby authorized,

upon receipt of the appropriately executed and notarized Loss Affidavit and a fee of $100.00, to

issue an appropriate duplicate tax sale certificate to the said purchaser covering the certificate

lost as previously described all in accordance with the requirements of Chapter 99 of Public

Laws of 1997.

BE IT FURTHER RESOLVED that a copy of this Resolution and the Loss Affidavit be

attached to the duplicate certificate to be issued to said purchaser and that said duplicate

certificate shall be stamped or otherwise have imprinted upon I the word “Duplicate” as required

by law.

2017-72 Resolution Authorizing Self-Examination for 2017 Municipal Budget

COUNTY OF BURLINGTON

AUTHORIZING SELF-EXAMINATION FOR 2017 MUNICIPAL BUDGET

WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that

permit municipalities in sound fiscal condition to assume the responsibility, normally granted to the

Director of the Division of Local Government Services, of conducting the annual budget examination;

and

WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997;

and

WHEREAS, pursuant to N.J.A.C. 5:30-7.2 through 7.5, the Township of North Hanover has

been declared eligible to participate in the program by the Division of Local government Services, and the

Chief Financial officer has determined that the local government meets the necessary conditions to

participate in the program for the 2017 budget year.

NOW THEREFORE BE IT RESOLVED by the governing body of the Township of North

Hanover that in accordance with N.J.A.C. 5:30-7.6a & 7.6b and based upon the Chief Financial Officer's

certification, the governing body has found the budget has met the following requirements:

1. That with reference to the following items, the amounts have been calculated pursuant to law

and appropriated as such in the budget:

a. Payment of interest and debt redemption charges

b. Deferred charges and statutory expenditures

c. Cash deficit of preceding year

d. Reserve for uncollected taxes

e. Other reserves and non-disbursement items

f. Any inclusions of amounts required for school

Purposes.

2. That the provisions relating to limitation on increases of appropriations pursuant to

N.J.S.A. 40A:4-45.2 and appropriations for exceptions to limits on appropriations found

at N.J.S.A. 40A:4-45.3 et seq., are fully met (complies with CAP law).

3. That the budget is in such form, arrangement, and content as required by the Local

Budget Law and N.J.A.C. 5:30-4 and 5:30-5.

4. That pursuant to the Local Budget Law:

a. All estimates of revenue are reasonable, accurate and correctly stated,

b. Items of appropriation are properly set forth

c. In itemization, form, arrangement and content, the budget will

permit the exercise of the comptroller function within the municipality.

5. The budget and associated amendments have been introduced and publicly advertised in

accordance with the relevant provisions of the Local Budget Law, except that failure to

meet the deadlines of N.J.S.A. 40A:4-5 shall not prevent such certification.

6. That all other applicable statutory requirements have been fulfilled.

BE IT FURTHER RESOLVED that a copy of this resolution will be forwarded to the Director

of the Division of Local Government Services upon adoption.

NON-CONSENT AGENDA

2017-73 Resolution Authorizing the Township of North Hanover to Execute an Agreement

with the County of Burlington Cooperative Participation in the Community

Development Act of 1974

RESOLUTION AUTHORIZING THE TOWNSHIP OF NORTH HANOVER TO

EXECUTE AN AGREEMENT WITH THE BURLINGTON COUNTY COOPERATIVE

PARTICIPATION IN THE COMMUNITY DEVELOPMENT ACT OF 1974

BE IT RESOLVED AND ENACTED, by the North Hanover Township Committee,

County of Burlington and State of New Jersey to authorize an Agreement with the

County of Burlington for cooperative participation in the Community Development Act

of 1974.

SECTION I. Certain federal funds are available to Burlington County under Title I of

the Housing and Community Development Act of 1987, Public Law 93-383, as amended;

and

SECTION II. It is necessary to establish a legal basis for the County and its people to

benefit from this Program; and

SECTION III. An Agreement has been proposed under which the Township of North

Hanover and the County of Burlington in cooperation with the other municipalities will

establish an Interlocal Services Program pursuant to N.J.S.A. 40:8a-1 et seq., and

SECTION IV. It is in the best interest of the Township of North Hanover that the

Agreement entitled “Agreement between the County of Burlington and certain

municipalities located therein for the establishment of a cooperative means of conducting

certain community development activities”, a copy of which is on file at the Municipal

Clerk’s Office.

SECTION V. The Township of North Hanover shall enter into the Agreement with the

County of Burlington mentioned with all supplements and agreements thereto. The

Mayor and Clerk are hereby authorized and directed to execute the Agreement on behalf

of North Hanover Township and affix thereunto the Official Seal.

SECTION VI. All resolutions or parts of resolutions which are inconsistent herewith are

hereby repealed in the extent of their inconsistency.

SECTION VII. This Resolution shall take effect immediately after passage and

publication as provided by law.

2017-74 Resolution Approving a Shared Services Agreement with the Township of

WHEREAS, beginning in 2012, every municipality in New Jersey is required by State

law to prepare mandatory Recycling Tonnage Reports that must be approved and signed by a

Certified Recycling Professional (CRP) and filed electronically with the NJDEP; and

WHEREAS, The Township of North Hanover does not have a Certified Recycling

Professional at this time and therefore, must enter into a Shared Services Agreement with a

municipality who will provide those services; and

WHEREAS, Christy Osborne of the Township of Burlington does possess the necessary

qualifications to file the annual Recycling Tonnage Report on behalf of the Township of North

Hanover.

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the

Township of North Hanover, County of Burlington, State of New Jersey that it hereby authorizes

a shared services agreement with the Township of Burlington for the purpose of providing a

Certified Recycling Professional (CRP) as mandated for the filing of the annual Recycling

Tonnage Reports.

2017-75 Resolution Authorizing Professional Service Agreement for Information

RESOLUTION AUTHORIZING PROFESSIONAL SERVICES AGREEMENT FOR

INFORMATION TECHNOLOGY SERVICES

WHEREAS on October 18, 2016, the Township of North Hanover published a notice for the

solicitation of proposals for Professional Services Agreement for Information Technology Services to

be appointed by the Township Committee; and

WHEREAS the proposals were solicited through a fair and open process in accordance with

N.J.S.A. 19:44A-20.4 et. seq.; and

WHEREAS, prior to the awarding the professional service agreements herein, the Township

Committee considered six (6) criteria for each applicant that included: the applicant’s qualifications,

the applicant’s general experience, the applicant’s specific experience with the Township of North

Hanover, if any, quantified achievement within the scope and nature of the services required,

compensation, and references; and

WHEREAS after receiving said proposals, and after review, the Township Committee

desires to award the Professional Service Agreement for Township Information Technology Services

for the calendar year 2017 to Jeffrey Katz of Jeffrey Katz Computers, LLC.

NOW THEREFORE BE IT RESOLVED by the Members of the North Hanover Township

Committee, Burlington County, State of New Jersey, that Jeffrey Katz of Jeffrey Katz Computers,

LLC. be awarded the contract for Information Technology Services through the Fair and Open

Process for the calendar year 2017 and the Mayor and Municipal Clerk are hereby authorized and

directed to execute professional service contract; and

BE IT FURTHER RESOLVED that the above professional appointments shall be subject to fee

schedules approved by the Members of the North Hanover Township Committee; and

BE IT FURTHER RESOLVED that the required “Notice of Contract Awards” shall be

published in the legal newspaper as required by law within ten (10) days of its passage.

date of hearing a complete copy of the Budget had been made available for public inspection and

shall be made available to each person upon request.

(MAYOR SETS THE PUBLIC HEARING FOR MAY 4, 2017)

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski reported the Easter Egg Hunt on April 15th at 10 a.m. He noted the

Events Committee was working on the Memorial Day Ceremony. He also stated they were

working on new venues and there were a lot of new ideas. He also noted the Recreation

Committee would like to have a ceremony at the Park for the improvements sometime in May.

Committeeman O’Donnell noted Deputy Mayor DeBaecke and he attended the JVFC awards

dinner and noted appreciation for the invite. He stated the event was well planned and attended.

Committeeman Doyle noted he just returned from vacation. He stated the Police Contract

negotiation was progressing. He noted his attendance at the BCJIF elected official training and

stated it was a good event.

Deputy Mayor DeBaecke was pleased with the up-coming bidding for Jones Mill Road and that

Provinceline Road would be worked on soon. He stated the Flag pole at the park looked great.

He also mentioned the new lighting on the dais.

Mayor DeLorenzo thanked the Recreation Events Committee.

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C.

404, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of North Hanover Township wishes to go into a

closed Executive Session and is of the opinion that such circumstances presently exist which

should not be discussed in public, and

WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.

10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case

for the purpose of the Township Committee to discuss contract negotiations, litigation and

personnel matters in this regard.

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover

Township that it will go into an Executive Session for the purpose of the Township Committee to

discuss Professional Service Contract Matter, Contract Matters, Litigation and Personnel matters.

BE IT FURTHER RESOLVED that the results of such discussion may be revealed at

such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are

formally settled. Interested parties may contact the Township Clerk anytime during normal

business hours for periodic updates as to the availability in this regard.
