Township bulletin board located in the foyer of the municipal building”.

Township Clerk Picariello noted an addendum to this evenings Agenda. Resolutions 2017-45A

and 2017-45B were added.

ENGINEER’S REPORT

Engineer Hirsh gave a brief synopsis of the NJDOT projects and noted he expects to go out to

Bid on March 14, 2017.

2017-40 Resolution Canceling Taxes

RESOLUTION CANCELING TAXES

WHEREAS, the United States Department of Veteran Affairs has classified Kyle

McGonigal 100% Permanently and Totally Disabled.

WHERAS, by application from Donald Kosul, Tax Assessor in the Township of North

Hanover, the said exemption is granted from December 21, 2016.

WHERAS, N.J.S.A. 54:4-3.30a – Allows for the exemption from taxation from real and

personal property for any citizen and resident of the State who has a total or 100% permanent

disability as defined by this statue.

WHEREAS, the following taxes must be canceled and any monies paid by the owner

should be refunded.

THEREFORE BE IT RESOLVED, that the following taxes be canceled:

BLOCK 201 LOT 12.10 1st half $3,409.05

THEREFORE BE IT RESOLVED FURTHER, that a copy of this Resolution be

forwarded to the Burlington County Board of Taxation, the Treasurer of Burlington

County, the Municipal/Regional School Board to advise them of the action taken by the

Township Committee on this matter.

2017-41 Resolution Appointing a Temporary Municipal Court Judge

RESOLUTION 2017-41

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

RESOLUTION APPOINTING A TEMPORARY MUNICIPAL COURT JUDGE

WHEREAS, the regularly appointed Municipal Court Judge will be unable to perform

the duties of Municipal Court Judge for the Municipal Courts of North Hanover Township and

Chesterfield Township as of January 31, 2017 through February 19, 2017; and

WHEREAS, Chapter 293, Laws of 1993 (N.J.S.A. 2B:12-5), provides for written

consent of the vicinage Assignment Judge when a municipality seeks to establish one or more

temporary Municipal Court Judge; and

WHEREAS, the Honorable Ronald Bookbinder, Assignment Judge for the Burlington

Vicinage has authorized the temporary assignment of Judge Bonnie Goldman Esquire (retired)

via Order dated December 19, 2016; and

WHEREAS, the Honorable Ronald Bookbinder, Assignment Judge for the Burlington

Vicinage extended this order until February 28, 2017 for the Municipal Courts of North Hanover

Township and Chesterfield Township; and

WHEREAS, Bonnie Goldman, J.M.C. (Retired) has agreed to accept this temporary

assignment at a rate of $500.00 per Court session.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the

Township of North Hanover and Chesterfield, County of Burlington, State of New Jersey that

Bonnie Goldman, J.M.C. (Retired) be and is hereby appointed to serve as the Temporary

Municipal Court Judge for the Township of North Hanover and Chesterfield Municipal Courts

on a temporary basis effective January 31, 2017 until February 19, 2017.

2017-42 Resolution Commemorating and Congratulating the Burlington County Municipal

Joint Insurance Fund on 25 Years of Successful Operations

A RESOLUTION COMMEMORATING AND CONGRATULATING THE BURLINGTON COUNTY MUNICIPAL JOINT INSURANCE

FUND ON 25 YEARS OF SUCCESSFUL OPERATIONS

WHEREAS, the Burlington County Municipal Joint Insurance Fund has been organized pursuant to N.J.S.A. 40A:10-36 et seq.,

and

WHEREAS, the Township of North Hanover is a member of the Burlington County Municipal Joint Insurance Fund; and

WHEREAS, the Burlington County Municipal Joint Insurance Fund commenced operations on January 1, 1991 with ten charter

members who, when challenged with an unfavorable market for their insurance, decided to join together to avoid the high costs

and limited coverage associated with traditional insurance for fire and property, liability and workers compensation risks; and

WHEREAS, over the past 25 years the Fund has grown to 27 members and stands today as one of the greatest examples of an

inter-local service agreement in the State of New Jersey’s history; and

WHEREAS, municipalities participating in the BURLCO JIF have saved their local taxpayers millions of dollars in the form of

lower premiums and the return of more than $7 million dollars in surplus distributions; and

WHEREAS, the elected officials and the municipal employees covered by the Burlington County Municipal Joint Insurance Fund

are the foundation of the Fund’s success and without whose dedication to the Fund Safety and Risk Management programs the

Fund would not have achieved the status it enjoys today; and

WHEREAS, the Township of North Hanover wishes to recognize and commemorate the Fund on its 25 years of successful

operation.

NOW, THEREFORE, BE IT RESOLVED, by the North Hanover Township Committee assembled in a public session on February 2,

2017, that this body does hereby recognize and congratulate the Burlington County Municipal Joint Insurance Fund on 25 years

of successful operation; and

BE IT FURTHER RESOLVED that the Township of North Hanover wishes to acknowledge this Anniversary as a milestone event in

the history of the Fund and wishes the Fund continued success for many years to come; and

BE IT FURTHER RESOLVED that a copy of this Resolution shall be provided to the Executive Director of the Burlington County

Municipal Joint Insurance Fund for his information and distribution to the membership.

RESOLUTION AUTHORIZING AN EXTENSION TO CONTRACT

BY AND BETWEEN THE TOWNSHIP OF NORTH HANOVER AND

JB LAWN AND LAND CARE, LLC FOR THE PROVISION OF GRASS CUTTING AND

MAINTENANCE OF NORTH HANOVER TOWNSHIP PROPERTY AND

RECREATION FIELDS WITHIN THE TOWNSHIP OF NORTH HANOVER

WHEREAS, the Township of North Hanover (hereinafter “Township”) previously

awarded by way of public bid by way of Resolution No. 2014-49 adopted April 3, 2014, a

contract (hereinafter “Contract”) to JB Lawn and Land Care, LLC having an address at 1058

Provinceline, Allentown, NJ 08501 (hereinafter “Contractor”) for the provision of Grass Cutting

and Maintenance services for the Township property and Recreation Fields for an initial term of

April 1, 2014 to March 31, 2016; and

WHEREAS, pursuant to the terms of the initial Contract and the Local Public Contracts

Law, N.J.S.A. 40A:11-1 et seq., the term of the Contract can be extended by the Township for up

to two (2), one-year additional terms, under the same terms and conditions of the awarded

contract, including price, unless a different price is accepted by the Township Committee in

accordance with the requirements of the New Jersey Local Public Contracts Law; and

WHEREAS, the Township Committee hereby finds that the services being provided by

the Contractor are being performed in an effective and efficient manner; and

WHEREAS, in accordance with the paragraph IV of the Contract, the Township wishes

to extend the term of the Contract for an additional ( second) one year term, commencing April

1, 2017 and terminating March 31, 2018, under the same terms and conditions, in effect under

the contract of the April 1, 2014 until March 31, 2016 Contract; and

WHEREAS, the Contractor has consented to the extension of the Contract under the

same terms and conditions of the 2014/2016 contract, which was set forth in an agreement

executed by the parties at $15,600.00;

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the

Township of North Hanover, County of Burlington, State of New Jersey that it does hereby

authorize a one year extension to the Contract with JB Lawn and Land Care, LLC having an

address at 1058 Provinceline Road, Allentown, NJ 08501 by extending the term of the contract

for one year term; with the contract prices as set forth herein above; with all other terms and

conditions of the contract remaining the same.

2017-45 Resolution Authorizing Consent to New Jersey Department of Environmental

Protection Permit for South’s Mobile Home Park

RESOLUTION AUTHORIZING CONSENT TO NEW JERSEY DEPARTMENT OF

ENVIRONMENTAL PROTECTION PERMIT FOR

SOUTH’S MOBILE HOME PARK

WHEREAS, South’s Mobile Home Park, located at 114 Cookstown-New Egypt Road in the

Township of North Hanover has made application to the New Jersey Department of Environmental

Protection (“NJDEP”) for a Treatment Works Approval Permit concerning Block 905, Lot 1; and

WHEREAS, the Township Engineer has reviewed said application made by the owner Par

Three Management LLC and has recommended execution of the same.

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of

North Hanover, County of Burlington County, State of New Jersey that the Township Committee hereby

consents to the proposed project and hereby authorizes the Township Engineer to execute the NJDEP

Statements of Consent on behalf of the Township.

DISCUSSION

JB DML off base water sampling

Committeeman Doyle stated he reached out to the JB MDL for an explanation. He gave a

brief synopsis of the exchange. He noted there is no concern, from the JB DLM in regards to

North Hanover Township. He also noted that he was seeking additional information and

was awaiting a response. Committeeman Kocubinski made mention of the RAB meetings

and that discussions concerning contamination are held there. Committeeman Doyle stated

he was aware and requested notification of the RAB meetings be sent to him. He noted the

last meeting was in December.

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski he has a budget issue concerning the Summer Recreation Program

and noted the reduction in funding from the School. He gave a synopsis of the issues ahead.

There was a general consensus of the Township Committee to move forward with the program

this year and future years of the program would be discussed during the Budget. Committeeman

Kocubinski thanked Attorney Roselli for the Resolutions with regards to the Pinelands and gave

a brief explanation. Attorney Roselli also briefed the Township Committee on the on-going

issue.

Committeeman O’Donnell noted he was working with the JVFC with some capital improvement

needs. He noted the need to update the Mobile Home Ordinance with regards to Sheds. He also

noted the FOP contract negotiation meeting is scheduled for February 9th.

Committeeman Doyle addressed the concerns of a Provinceline Road resident, expressed last

meeting, with regards to 911 Communications with a cell phone. He spoke with Chief of Police

and researched FCC rules. He gave some guidance and noted he was also seeking additional

information and would reach out to the resident at that time.

Deputy Mayor DeBaecke stated it has been a mild year thus far. He gave pricing to replace signs

in front of Municipal Building and would be donating his time to assist the Groundskeeper in

installing the new sign.

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C.

404, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of North Hanover Township wishes to go into a

closed Executive Session and is of the opinion that such circumstances presently exist which

should not be discussed in public, and

WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.

10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case

for the purpose of the Township Committee to discuss contract negotiations, litigation and

personnel matters in this regard.

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover

Township that it will go into an Executive Session for the purpose of the Township Committee to

discuss Contract Matters, Litigation and Personnel matters.

BE IT FURTHER RESOLVED that the results of such discussion may be revealed at

such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are

formally settled. Interested parties may contact the Township Clerk anytime during normal

business hours for periodic updates as to the availability in this regard.
