2017-01 An Ordinance of the Township of North Hanover, County of Burlington, State of

New Jersey, Authorizing the Sale of Certain Lands Owned by the Township of

North Hanover Pursuant to N.J.S.A. 40A:12-13

ORDINANCE 2017- 01

AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE OF

NEW JERSEY, AUTHORIZING THE SALE OF CERTAIN LANDS OWNED BY THE TOWNSHIP OF

NORTH HANOVER PURSUANT TO N.J.S.A. 40A:12-13

WHEREAS, pursuant to N.J.S.A. 40A:12-13(b)(5), the Township is authorized to sell by private sale to

the owner of real property contiguous to real property owned by the Township provided that the property being

sold is less than the minimum size required for development under the municipal zoning ordinance and is

without any capital improvement thereon; and

WHEREAS, the Township Committee has determined to sell the real property identified as Block 905,

Lot 20 currently owned by the Township of North Hanover, by way of private sale in accordance with N.J.S.A.

40A:12-13(b)(5), as they are not needed for public use; and

WHEREAS, in accordance with N.J.S.A. 40A:12-13(b) (5), on February 9, 2017, the property owner

owning property contiguous to Block 905, Lot 20 was mailed written notice by way of U.S. regular mail and

certified mail, return receipt requested, informing them of the Township’s intention to sell the subject real

property and requesting that they submit a bid for the real property on or before March 1, 2017; and

WHEREAS, the Municipal Clerk received the bid for said property from Richard Tracy having an

address at 22 Mary Street, Wrightstown, New Jersey in the amount of $2,500.00; and

WHEREAS, the Tax Assessor for the Township of North Hanover has determined that the bid received

is not less than the fair market value for said property.

NOW, THEREFORE, be it ordained by the Township Committee of the Township of North Hanover,

in the County of Burlington, New Jersey as follows:

Section 1. Pursuant to N.J.S.A. 40A:12-13(b)(5), it is hereby determined that the real property identified

as Block 905, Lot 20 on the Township of North Hanover Tax Map is not needed for public use.

Section 2. Pursuant to N.J.S.A. 40A:12-13(b) (5), the Township of North Hanover is hereby authorized

to sell Block 905, Lot 20 to Richard Tracy, having an address at 22 Mary Street, Wrightstown, New Jersey, the

adjoining property owner, for the bid price of $2,500.00, which is the highest and only bid received from the

contiguous property owner and the Township Attorney shall take all steps necessary to effectuate the sale and

closing for the subject real property.

Section 3. The Clerk shall provide the requisite notice of the sale of the aforesaid properties in

accordance with N.J.S.A. 40A:13 (b) (5).

Section 4. In the event that any portion of this ordinance is determined to be invalid, such determination

shall not affect he remaining portions of ordinance, which are hereby declared to be severable.

Section 5. All ordinance or parts thereof, which are inconsistent with the provisions of this Ordinance,

are hereby repealed to the extent of such inconsistency.

Section 6. This ordinance shall take effect immediately after final passage and publication according to

law.

Officers, Appointees, and Employees to be appointed in Township Positions to carry out the

lawful duties and responsibilities of the Township; and

WHEREAS, the Township of North Hanover has entered into a contract with the North

Hanover Township Police Association that provides provide for the rate of Compensation,

Salary, or Wages of Certain Officers, Appointees and Employees of said Township.

NON-CONSENT AGENDA

There were no items for consideration this evening.

DISCUSSION

Community Events

Committeeman Kocubinski noted there were some questions from the Recreation Advisory

Committee regarding their responsibilities for the Memorial Day Parade and the Country Fair

if it was re-established. There was discussion among the Committee Members and the

Recreation Chair, Twan Berben. The general consensus was that the Memorial Day Parade

would fall under the Recreation Committee. There also was a general consensus that a subcommittee

could be established under the Recreation Committee. Committeeman

Kocubinski noted the Easter Egg Hunt is scheduled for April 15th and that a request was

made for a bouncy house. After deliberation, there was a general consensus not to allow the

bouncy house due to liability concerns. Committeeman Kocubinski reported about the prior

correspondence from the County regarding the CDBG program. He noted he sent a note to

the director to make sure we are kept informed and he would continue to keep the Committee

informed.

Capital Budget

Deputy Mayor DeBaecke asked to further deliberate the prior Capital Budget discussions.

He digested the requests and has some concerns over incurring additional debt. There was

additional discussion regarding the police vehicle requests. Committeeman Doyle gave an

overview. There was additional discussion regarding Fire Department capital budget items.

Committeeman O’Donnell gave an overview. Mayor DeLorenzo noted there is additional

Capital funding that was set aside a long time ago. Mayor DeLorenzo wants to use that

money and not borrow so much. He noted the CFO was unable to attend and that there

would be a need to schedule a special meeting for further debate on the matter with the CFO

present. He also noted that he has asked the CFO to work a budget without an increase to

taxpayers. Committeeman Kocubinski expressed concerns relating to not having an increase.

Deputy Mayor DeBaecke noted he is not against these improvements but wants to be

cautious about incurring debt. Committeeman O’Donnell noted by not purchasing new

vehicles there would be substantial repair costs. Committeeman Doyle believes a spending

policy should be explored. Mayor DeLorenzo expressed concerns over the Fire Chief vehicle

and noted exploring the used vehicle would be prudent. Committeeman O’Donnell

explained it would be a primary vehicle for the department and it had over 200K miles and

would do some investigating. Deputy Mayor DeBaecke wanted to know what is wrong with

the Fire Chief truck. There was a general consensus to have another special budget work

session.

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski noted notification was received from the NJDEP that the permits

were issued for the SRL pipeline. He inquired, with Attorney Roselli, if the Municipality would

have legal standing due to the financial impact of possible lower values. Attorney Roselli stated

this would be a claim unique to a property owner and would not be a direct injury to the

Municipality. Mayor DeLorenzo noted the homeowner could try and is very disappointed about

the pipeline in general.

Deputy Mayor DeBaecke noted the last snow fall was handled well and no complaints were

received by the Township Clerk’s office. He noted the County did a better job also. Mayor

DeLorenzo noted it was a good job and there was minimum power loss. Deputy Mayor

DeBaecke noted he was happy they could have a good debate on the budget and that he needs to

be able to make sure he does the best he can do with the resources available.

PUBLIC PARTICIPATION

Questions, comments or statements from members of the public in attendance.

Mayor DeLorenzo opened the meeting to the public.

Mr. Ralph Ruocco – 101 Chesterfield-Arneytown Road – Mr. Ruocco inquired if Recycling

would be on Friday. Clerk Picariello informed him yes and it was posted on the website and

email blasted. He noted he agrees with Mayor DeLorenzo that spending of monies should be

kept to a minimum. He noted the Municipal Budget is only one component of the tax rate and

has concerns over the other entities budgets and encourages the Committee to be mindful of this.

He also stated the values of properties would affect the Municipal budget.

Joanne Christos – 73 Streeker Road – Ms. Christos expressed various concerns over the

firefighting foam, in the water system, at the JBMDL. Committeeman Doyle gave an

explanation of his efforts so far to include the NJDEP and the EPA. He noted he would be happy

to share his information with her. He noted the combined entities are still stating there are not

concerns for North Hanover Township due to the water flow.

Wayne Voorhees – President, JVFC – Mr. Voorhees reported that a vote was taken, among his

members, and it was unanimous to contribute $30,000 toward the ambulance purchase.

Personnel and Litigation matters

RESOLUTION 2017-64

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

AUTHORIZING A CLOSED SESSION MEETING

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C.

404, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of North Hanover Township wishes to go into a

closed Executive Session and is of the opinion that such circumstances presently exist which

should not be discussed in public, and

WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.

10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case

for the purpose of the Township Committee to discuss contract negotiations, litigation and

personnel matters in this regard.

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover

Township that it will go into an Executive Session for the purpose of the Township Committee to

discuss Police Contract Matter, Police Chief Personnel Matter, Professional Service Contract

Matters, Litigation and Personnel matters.

BE IT FURTHER RESOLVED that the results of such discussion may be revealed at

such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are

formally settled. Interested parties may contact the Township Clerk anytime during normal

business hours for periodic updates as to the availability in this regard.
