PRESENTATION OF SERVICE AWARDS TO MEMBERS OF THE NORTH

HANOVER TOWNSHIP POLICE DEPARTMENT

Committeeman Doyle gave an overview and origin of “Police Week” and thanked those that

were in attendance. He read the poem “The Judgement” before Chief Wells, Mayor DeLorenzo

and Committeeman Doyle honored various members of the North Hanover Township Police

Department. Chief Wells expressed gratitude for the members of the Police Department.

law and shall be effective as of January 1, 2017 or date of hire or appointment if after January 1,

2017.

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP

OF NORTH HANOVER, IN THE COUNTY OF BURLINGTON, NEW JERSEY (not less

than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:

Section 1. The improvement or purpose described in Section 3 of this bond

ordinance is hereby authorized to be undertaken by the Township as a general improvement. For

the improvement or purpose described in Section 3 hereof, there is hereby appropriated the sum

of $156,000, including the sum of $7,800 as the down payment required by the Local Bond Law.

The down payment has been made available by virtue of provision for down payment or for

capital improvement purposes in one or more previously adopted budgets.

Section 2. In order to finance the cost of the improvement or purpose not covered

by application of the down payment or otherwise provided for hereunder, negotiable bonds or

notes are hereby authorized to be issued in the principal amount of $148,200, pursuant to the

Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes

are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local

Bond Law.

Section 3. (a) The improvements hereby authorized and the purposes for which

the bonds or notes are to be issued are as follows:

I. Purpose. Acquisition of two (2) SUV Vehicles for the Police

Department, as set forth in a list on file in the office of the Township Clerk, including all work

and related materials necessary thereof or incidental thereto.

Appropriated and Estimated Cost: $124,000

Estimated Maximum Amount of Bonds or Notes: $117,800

Period or Average Period of Usefulness: 5 years

Amount of Down Payment: $6,200

II. Purpose. Improvements to the Township Buildings and Grounds,

including but not limited to repair and improvements to municipal garage roof, as set forth in a

list on file in the office of the Township Clerk, including all work and related materials

necessary thereof or incidental thereto.

Appropriated and Estimated Cost: $8,000

Estimated Maximum Amount of Bonds or Notes: $7,600

Period or Average Period of Usefulness: 10 years

Amount of Down Payment: $400

III. Purpose. Acquisition of Equipment including but not limited to

computers and related equipment, as set forth in a list on file in the office of the Township Clerk,

including all work and related materials necessary thereof or incidental thereto.

Appropriated and Estimated Cost: $24,000

Estimated Maximum Amount of Bonds or Notes: $22,800

Period or Average Period of Usefulness: 5 years

Amount of Down Payment: $1,200

(b) The estimated maximum amount of bonds or notes to be issued

for the improvement or purpose is as stated in Section 2 hereof.

(c) The estimated cost of the improvement or purpose authorized

herein is equal to the amount of the appropriation herein made therefor.

Section 4. All bond anticipation notes issued hereunder shall mature at such times

as may be determined by the chief financial officer; provided that no note shall mature later than

one year from its date. The notes shall bear interest at such rate or rates and be in such form as

may be determined by the chief financial officer. The chief financial officer shall determine all

matters in connection with notes issued pursuant to this bond ordinance, and the chief financial

officer's signature upon the notes shall be conclusive evidence as to all such determinations. All

notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A.

40A:2-8(a). The chief financial officer is hereby authorized to sell part or all of the notes from

time to time, at not less than par and accrued interest, at public or private sale and to deliver them

to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest

from their dates to the date of delivery thereof. The chief financial officer is directed to report in

writing to the governing body at the meeting next succeeding the date when any sale or delivery

of the notes pursuant to this bond ordinance is made. Such report must include the amount, the

description, the interest rate and the maturity schedule of the notes sold, the price obtained and

the name of the purchaser.

Section 5. The capital budget or temporary capital budget (as applicable) of the

Township is hereby amended to conform with the provisions of this bond ordinance to the extent

of any inconsistency herewith. In the event of any such inconsistency and amendment, the

resolution in the form promulgated by the Local Finance Board showing full detail of the

amended capital budget or amended temporary capital budget (as applicable) and capital

program as approved by the Director of the Division of Local Government Services is on file

with the Clerk and is available there for public inspection.

Section 6. The following additional matters are hereby determined, declared,

recited and stated:

(a) The improvements or purposes described in Section 3 of this bond

ordinance are not current expenses. They are improvements or purposes the Township may

lawfully undertake as general improvements, and no part of the cost thereof has been or shall be

specially assessed on property specially benefited thereby.

(b) The period of usefulness of the improvement or purpose, within the

limitations of the Local Bond Law, is 5.25 years.

(c) The Supplemental Debt Statement required by the Local Bond Law has

been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof

has been filed in the office of the Director of the Division of Local Government Services in the

Department of Community Affairs of the State of New Jersey. Such statement shows that the

gross debt of the Township as defined in the Local Bond Law is increased by the authorization of

the bonds and notes provided in this bond ordinance by $148,200, and the obligations authorized

herein will be within all debt limitations prescribed by that Law.

(d) An aggregate amount not exceeding $7,000 for items of expense listed

in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for

the improvement or purpose.

(e) The Township reasonably expects to commence the acquisition of the

improvement or purpose described in Section 3 hereof, and to advance all or a portion of the

costs in respect thereof, prior to the issuance of bonds or notes hereunder. To the extent such

costs are advanced, the Township further reasonably expects to reimburse such expenditures

from the proceeds of the bonds or notes authorized by this bond ordinance, in an aggregate

amount not to exceed the amount of bonds or notes authorized in Section 1 hereof.

Section 7. Any grant moneys received for the purposes described in Section 3

hereof, exclusive of the State Grant already appropriated herein, shall be applied either to direct

payment of the cost of the improvements or to payment of the obligations issued pursuant to this

bond ordinance. The amount of obligations authorized hereunder shall be reduced to the extent

that such funds are so used.

Section 8. The full faith and credit of the Township is hereby pledged to the

punctual payment of the principal of and the interest on the obligations authorized by this bond

ordinance. The obligations shall be direct, unlimited obligations of the Township, and the

Township shall be obligated to levy ad valorem taxes upon all the taxable real property within

the Township for the payment of the obligations and the interest thereon without limitation as to

rate or amount.

Section 9. The Township Committee hereby covenants on behalf of the Township

to take any action necessary or refrain from taking such action in order to preserve the

tax-exempt status of the bonds and notes authorized hereunder as is or may be required under the

Internal Revenue Code of 1986, as amended, and the regulations promulgated thereunder (the

"Code"), including compliance with the Code with regard to the use, expenditure, investment,

timely reporting and rebate of investment earnings as may be required thereunder.

Section 10. This bond ordinance shall take effect 20 days after the first

publication thereof after final adoption, as provided by the Local Bond Law.

than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:

Section 1. The improvement or purpose described in Section 3 of this bond

of $102,000, said sum being inclusive of all appropriations heretofore made therefor and

including the sum of $49,000 from the Township’s accounts held for capital improvement

purposes in one or more previously adopted budgets and the sum of $30,000 received by the

Township from the Jacobstown Fire Company for the purposes set forth in Section 3.

Section 2. In order to finance the cost of the improvement or purpose not

covered by application of the down payment or otherwise provided for hereunder, negotiable

bonds or notes are hereby authorized to be issued in the principal amount of $23,000, pursuant to

the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation

notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the

Local Bond Law.

Section 3. (a) The improvement hereby authorized and the purpose for which

the bonds or notes are to be issued is the acquisition of an ambulance vehicle for use by the

Township’s Fire Department including customization and related equipment to allow the

vehicles to be used for its intended use, and including all work and related materials necessary

therefor and incidental thereto.

(b) The estimated maximum amount of bonds or notes to be issued for

the improvement or purpose is as stated in Section 2 hereof.

(c) The estimated cost of the improvement or purpose authorized

herein is equal to the amount of the appropriation herein made therefor.

Section 4. All bond anticipation notes issued hereunder shall mature at such

of $450,000, inclusive of $416,000 in grant monies received from the New Jersey Department of

Transportation and further including the sum of $1,700 as the down payment required by the

Local Bond Law. The down payment has been made available by virtue of provision for down

payment or for capital improvement purposes in one or more previously adopted budgets.

Section 2. In order to finance the cost of the improvement or purpose not covered

by application of the down payment or otherwise provided for hereunder, negotiable bonds or

notes are hereby authorized to be issued in the principal amount of $32,300, pursuant to the

Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes

are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local

Bond Law.

Section 3. (a) The improvement hereby authorized and the purpose for which the

bonds or notes are to be issued is the Jacobstown-Arneytown Road Project – Phase III and the

Jones Mill Road Improvements Project - Phase I, a summary of which is one file in the Office of

the Township Clerk, and further including all work and related materials necessary therefor and

incidental thereto.

(b) The estimated maximum amount of bonds or notes to be issued for

the improvement or purpose is as stated in Section 2 hereof.

(c) The estimated cost of the improvement or purpose authorized

herein is equal to the amount of the appropriation herein made therefor.

Section 4. All bond anticipation notes issued hereunder shall mature at such times

as may be determined by the chief financial officer; provided that no note shall mature later than

one year from its date. The notes shall bear interest at such rate or rates and be in such form as

may be determined by the chief financial officer. The chief financial officer shall determine all

matters in connection with notes issued pursuant to this bond ordinance, and the chief financial

officer's signature upon the notes shall be conclusive evidence as to all such determinations. All

notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A.

40A:2-8(a). The chief financial officer is hereby authorized to sell part or all of the notes from

time to time, at not less than par and accrued interest, at public or private sale and to deliver them

to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest

from their dates to the date of delivery thereof. The chief financial officer is directed to report in

writing to the governing body at the meeting next succeeding the date when any sale or delivery

of the notes pursuant to this bond ordinance is made. Such report must include the amount, the

description, the interest rate and the maturity schedule of the notes sold, the price obtained and

the name of the purchaser.

Section 5. The capital budget or temporary capital budget (as applicable) of the

Township is hereby amended to conform with the provisions of this bond ordinance to the extent

of any inconsistency herewith. In the event of any such inconsistency and amendment, the

resolution in the form promulgated by the Local Finance Board showing full detail of the

amended capital budget or amended temporary capital budget (as applicable) and capital

program as approved by the Director of the Division of Local Government Services is on file

with the Clerk and is available there for public inspection.

Section 6. The following additional matters are hereby determined, declared,

recited and stated:

(a) The improvements or purposes described in Section 3 of this bond

ordinance are not current expenses. They are improvements or purposes the Township may

lawfully undertake as general improvements, and no part of the cost thereof has been or shall be

specially assessed on property specially benefited thereby.

(b) The period of usefulness of the improvement or purpose, within the

limitations of the Local Bond Law, is 20 years.

(c) The Supplemental Debt Statement required by the Local Bond Law has

been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof

has been filed in the office of the Director of the Division of Local Government Services in the

Department of Community Affairs of the State of New Jersey. Such statement shows that the

gross debt of the Township as defined in the Local Bond Law is increased by the authorization of

the bonds and notes provided in this bond ordinance by $32,300, and the obligations authorized

herein will be within all debt limitations prescribed by that Law.

(d) An aggregate amount not exceeding $54,400 for items of expense

listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein

for the improvement or purpose.

(e) The Township reasonably expects to commence the acquisition of the

improvement or purpose described in Section 3 hereof, and to advance all or a portion of the

costs in respect thereof, prior to the issuance of bonds or notes hereunder. To the extent such

costs are advanced, the Township further reasonably expects to reimburse such expenditures

from the proceeds of the bonds or notes authorized by this bond ordinance, in an aggregate

amount not to exceed the amount of bonds or notes authorized in Section 1 hereof.

Section 7. Any grant moneys received for the purposes described in Section 3

hereof, exclusive of the State Grant already appropriated herein, shall be applied either to direct

payment of the cost of the improvements or to payment of the obligations issued pursuant to this

bond ordinance. The amount of obligations authorized hereunder shall be reduced to the extent

that such funds are so used.

Section 8. The full faith and credit of the Township is hereby pledged to the

punctual payment of the principal of and the interest on the obligations authorized by this bond

ordinance. The obligations shall be direct, unlimited obligations of the Township, and the

Township shall be obligated to levy ad valorem taxes upon all the taxable real property within

the Township for the payment of the obligations and the interest thereon without limitation as to

rate or amount.

Section 9. The Township Committee hereby covenants on behalf of the Township

to take any action necessary or refrain from taking such action in order to preserve the

tax-exempt status of the bonds and notes authorized hereunder as is or may be required under the

Internal Revenue Code of 1986, as amended, and the regulations promulgated thereunder (the

"Code"), including compliance with the Code with regard to the use, expenditure, investment,

timely reporting and rebate of investment earnings as may be required thereunder.

Section 10. This bond ordinance shall take effect 20 days after the first

publication thereof after final adoption, as provided by the Local Bond Law.

A RESOLUTION AUTHORIZING APPROVAL BY THE TOWNSHIP COMMITTEE

OF THE TOWNSHIP OF NORTH HANOVER FOR THE NORTH HANOVER

TOWNSHIP POLICE DEPARTMENT TO APPLY AND PARTICIPATE IN THE LAW

ENFORCMENT SUPPORT OFFICE (LESO) 1033 PROGRAM

WHEREAS, Congress authorized the 1033 Program to make use of excess Department

of Defense (DOD) equipment by making it available at the local, county and state level. This

excess DOD equipment has been purchased with taxpayer funds. Law enforcement may request

resources from this program. The Defense Logistics Agency (DLA) mandates that all acquired

1033 equipment be under the control of the requesting law enforcement agency. The equipment

may enhance community preparedness, response, a resiliency while off-setting the costs in a time

of fiscal constraints; and

WHEREAS, Senate Bill 2364(a) requires that all local or county law enforcement

agencies be approved by resolutions by the majority of the full membership of the governing

body prior to the transmittal of 1033 Program application. The DLA requires that applications

for program participation be submitted every 365 days; and

WHEREAS, in this era of fiscal constraint, participation in the 1033 Program allows

local units to obtain equipment that they might not otherwise be able to afford, and to prepare

for, respond to, and recover from incidents of terrorism, counter drug interdiction, and natural

disaster such as hurricanes and severe floods, by complying with Sections 2(A) and 2(B) of

Senate Bill 2364; and

WHEREAS, the Township Committee of the Township of North Hanover, in complying

with Senate Bill No. 2364 sections 2(b), finds that North Hanover Township Police Department

may request and acquire any Demilitarization (DEMIL) items with a code of A and Q with an

Integrity Code of 6, without restriction and additional resolutions from the Township Committee;

and

WHEREAS, the Township Committee of the Township of North Hanover, in complying

with Senate Bill 2364 sections 2(b), finds that North Hanover Township Police Department may

request and acquire any Demilitarization (DEMIL) items with a code of B through G and items

with a Code of Q with an integrity Code of 3 without restriction and additional resolutions from

the Township Committee, and

WHEREAS, the Township of North Hanover Police Department shall be in accordance

with all terms, conditions and requirements set forth by the New Jersey Office of Emergency

Management-Law Enforcement Support Office State Plan of Operation and Memorandum of

Agreement; and

WHEREAS, it is in the best interest of the residents of the Township of North Hanover

that the North Hanover Township Police Department apply and participated in the LESO 1033

Program; and

WHEREAS on October 18, 2016, the Township of North Hanover published a notice for the

solicitation of proposals for Professional Services Agreement for Municipal Prosecutor to be

appointed by the Township Committee; and

WHEREAS the proposals were solicited through a fair and open process in accordance with

N.J.S.A. 19:44A-20.4 et. seq.; and

WHEREAS, prior to the awarding the professional service agreements herein, the Township

Committee considered six (6) criteria for each applicant that included: the applicant’s qualifications,

the applicant’s general experience, the applicant’s specific experience with the Township of North

Hanover, if any, quantified achievement within the scope and nature of the services required,

compensation, and references; and

WHEREAS after receiving said proposals, and after review, the Township Committee

desires to award the Professional Service Agreement for Municipal Prosecutor for the remainder of

the calendar year 2017 to Stephen J. Wenger.

NOW THEREFORE BE IT RESOLVED by the Members of the North Hanover Township

Committee, Burlington County, State of New Jersey, that Stephen J. Wenger, Esq. be awarded the

contract for Municipal Prosecutor through the Fair and Open Process for the remainder of the

calendar year 2017 and the Mayor and Municipal Clerk are hereby authorized and directed to execute

professional service contract; and

BE IT FURTHER RESOLVED that the above professional appointments shall be subject to fee

WHEREAS, there currently exists a vacancy in that office and the Township Committee

is desirous of filling that vacancy with the appointment of a Municipal Clerk; and

WHEREAS, in accordance with N.J.S.A. 40A:9-135, the Township Committee desires

to appoint Mary Alice Picariello as Municipal Clerk for the Township of North Hanover

effective as of May 8, 2017, for a three year term expiring May 8, 2020; and

WHEREAS, the Township Salary Ordinance provides for the rate of Compensation,

Salary, or Wages of Certain Officers, Appointees and Employees of said Township.

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the

DISCUSSION

Committeeman Kocubinski noted an email received from Patty Cronheim with regards to

solidarity with regards to the DEP rejecting Penn East’s application. Attorney Lozier noted this

would be done by Resolution and researching of the facts would take some time. There would

not be enough time to act this evening. Committeeman Kocubinski concurred and note although

the Committee was in agreement, the research would need to be conducted first.

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski noted the Clerk passed the test the first time out despite the personal

issues that were being faced and wanted to recognize this exceptional achievement. He also

noted the Memorial Day Parade was all scheduled. He also noted the JBMDL wreath ceremony.

Committeeman Doyle noted he was proud of the Police Department and their commitment to the

Community.

Mayor DeLorenzo stated he was looking forward to the Memorial Day parade. He noted it is a

sad day for him. He had lost his brother in Vietnam.

Mayor DeLorenzo opened the meeting to the public.

Ms. Patricia Wossel – Ms. Wossel expressed concerns over 911 calls. She gave an overview of

her latest trouble calling 911. She noted this was a serious problem. Mayor DeLorenzo

expressed his concerns. Committeeman Doyle noted the landlines would have to be tested. He

noted cell service goes through the Federal Communication Agency. He noted the Tower

depends on the cell phone carrier. Committeeman O’Donnell suggests that Ms. Wossel call the

cell phone carrier and ask them what Tower and report back and the Committee could research

further. Committeeman Doyle stated he would follow up. Committeeman O’Donnell suggests

contacting Verizon, for the landline, and have the FIO box programmed. Mayor DeLorenzo

stated he would do what he can and asked Ms. Wossel to contact Verizon and report back.

Ms. Maria Sessa – JCPL – She noted last month’s Topic of the Month concerning electrical

lines. She stated LED lighting is available and should have Engineer review. The lights could

be changed out at no cost. She stated street lighting is changed at the Municipalities request.

closed Executive Session and is of the opinion that such circumstances presently exist which

should not be discussed in public, and

WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.

10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case

for the purpose of the Township Committee to discuss contract negotiations, litigation and

personnel matters in this regard.

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover

Township that it will go into an Executive Session for the purpose of the Township Committee to

discuss Police Department Personnel Matter, Contract Matters, Litigation and Personnel matters.

BE IT FURTHER RESOLVED that the results of such discussion may be revealed at

such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are

formally settled. Interested parties may contact the Township Clerk anytime during normal
