SUNSHINE STATEMENT:         “The provisions of the Open Public Meetings Act have been met. Notice of this meeting has been transmitted by email to the Courier Post, Burlington County Times and The Trenton Times as well as given to those having requested same and posted on the Township bulletin board located in the foyer of the municipal building”.

 

EAGLE SCOUT PRESENTATION – MARCUS DETLOFF

Marcus Detloff introduced himself to the Township Committee.  He noted he was a Sophmore at Northern Burlington.  He gave an overview of his Eagle project.  He stated it would be a flag drop and would be serviced monthly in conjunction with the ROTC at the school.  There were various questions asked by the Township Committee.  Marcus expects the project to be complete in the middle of May.  There was a general consensus to move forward.  Marcus Detloff would reach out to meet with Mayor, at a later date, to pick an appropriate spot to locate it.

REVIEW OF CORRESPONDENCE

1.      State of New Jersey NJDOT FY 2019 – Clerk Picariello noted the FY2019 NJDOT award was issued for Springfield Road in an amount of $73,990.00. 

 

ENGINEER’S REPORT

Engineer Hirsh stated the Park project quotes should be in by next meeting.  He stated the 2015 NJDOT project drainage improvements were done.  He was awaiting the schedule for paving.  The Schoolhouse Road project letter has not been received but he has received verbal permission to go out to bid.  He stated he is waiting on the Maintenance Bond for Provinceline Road and noted the Meany Road guardrail has been completed.  Committeeman Kocubinski inquired, on behalf of the Recreation Advisory, if there was enough money in the grant to fix the field on Green Acres.  Engineer Hirsh stated that could be determined after quotes are received for the restrooms.  Mayor DeBaecke noted he did ask Engineer Hirsh that last week.

Committeeman Doyle inquired about the snow bill.  Deputy Mayor O’Donnell noted it was in order.

 

ORDINANCE – ADOPTION

2019-01           Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank Pursuant to N.J.S.A. 40A:4-45.14

COUNTY OF BURLINGTON

TOWNSHIP OF NORTH HANOVER

 

CALENDAR YEAR 2019

ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS

AND TO ESTABLISH A CAP BANK  (N.J.S.A. 40A: 4-45.14)

 

WHEREAS, the Local Government CAP Law, N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and

 

WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 2.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and 

 

WHEREAS, the Township Committee of the Township of North Hanover in the County of Burlington finds it advisable and necessary to increase its CY 2019 budget by up to 3.5% over the previous year=s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and

 

WHEREAS, the Township Committee of the Township of North Hanover in the County of Burlington hereby determines that a 3.5% increase in the budget for said year, amounting to $ 26.953.60 in excess of the increase in final appropriations otherwise permitted by the Local Government CAP Law, is advisable and necessary; and,

 

WHEREAS, the Township Committee of the Township North Hanover of in the County of Burlington hereby determines that any amount authorized herein above that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

 

NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township of North Hanover in the County of Burlington, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2019 budget year, the final appropriations of the Township of North Hanover shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $ 94,337.60, and that the CY 2019 municipal budget for the Township of North Hanover be approved and adopted in accordance with this ordinance; and

 

BE IT FURTHER ORDAINED, that any amount authorized herein above that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon; be filed with said Director within 5 days after such adoption.

COUNTY OF BURLINGON

TOWNSHIP OF NORTH HANOVER

AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE OF NEW JERSEY APPROPRIATING $20,000.00 FROM THE CAPITAL IMPROVEMENT FUND TO PROVIDE FOR THE PURCHASE OF FIRE COMPANY VEHICLE

BE IT ORDAINED by the Township Committee of the Township of North Hanover, in the County of Burlington, State of New Jersey, as follows:

 

SECTION 1. $20,000.00 is hereby appropriated from the Capital Improvement Fund of the Township of North Hanover, in the County of Burlington, New Jersey (the “Township”) to provide for the purchase of Fire Company Vehicle and accessory equipment therefor and incidental thereto.

 

SECTION 2.            Said acquisitions are lawful capital improvements of the Township having a period of usefulness of at least five (5) years.  Said improvements and acquisitions shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited.

 

SECTION 3.            This ordinance shall take effect upon final passage and publication according to law.

APPOINTMENT OF EMERGENCY MANAGEMENT COORDINATOR

 

WHEREAS, N.J.S.A. Title 40 and Title 40A provide for the Appointment of Certain Officers, Appointees and Employees to be appointed in Township Positions to carry out the lawful duties and responsibilities of the Township; and

 

            WHEREAS, the Township Salary Ordinance provides for the rate of Compensation, Salary or Wages of Certain Officers, Appointees and Employees of said Township.

 

            WHEREAS, North Hanover Township Committee has recognized the statutory need to fill the position of Emergency Management Coordinator in order to conduct the day-to-day operations of North Hanover Township.

 

NOW, THEREFORE, BE IT RESOLVED by North Hanover Township Committee hereby appoints Richard Mellor as the Emergency Management Coordinator effective June 1, 2018, for a three year term expiring June 1, 2021.

DISCUSSION

·        CDBG Fiscal Years 2021-2023 – Clerk Picariello noted our participation in the program and the request to continue. This program is to assist residents in various aspects of homeownership and repair.  After discussion, there was a discussion to move forward.

 

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski noted the recent Recreation Advisory Committee meeting.  He stated the first softball game is April 11th.  He noted Memorial Day Parade would be May 25th and the Recreation Committee would like Myron shut down for staging.  Committeeman Doyle noted that should not be a problem.  Committeeman Kocubinski noted the Easter Egg hunt on April 20th and a tentative date for Movie night is September 20th. 

 

Committeeman Doyle noted a family emergency and thanked the Emergency Services for their fine work.

 

Mayor DeBaecke expressed pleasure in the up-coming events and noted a Color Run would be happening at the Park in the near future.

 

PUBLIC PARTICIPATION

Questions, comments or statements from members of the public in attendance.

 

Mayor DeBaecke opened the meeting to the public.

 

Mr. Paul Reuter – 8 Ivy Lane – Mr. Reuter expressed various concerns over the legalization of Marijuana and would like the Township Committee to pass an Ordinance to prevent it. He noted there were 60 towns that have acted.  Mayor DeBaecke noted this would be looked into.  Committeeman Doyle noted he was against recreational use but supported it for Medical purposes.  Committeeman Kocubinski noted regulations as it relates to preserved farms and that would need to be look into.  He stated State Law would supersede Local laws.

 

Mr. Emmons – 607 Hanover Drive – He thanked the Township Committee for their service.  He stated there is a drainage issue, on the front of his property, since the paving.  He has concerns over mosquitos and noted he has lost his yard because of swamp like conditions.  He is looking for solutions.  He wanted to dig a ditch.  After discussion, the current Engineer would be out to take a look and report back.

 

Mr. Carmichael – 610 Hanover Drive - Mr. Carmichael expressed concerns over the drainage at his driveway.  Mayor DeBaecke noted the prior engineer did look and noted the catch basin was clogged.  Mr. Carmichael expressed other concerns.  Mayor DeBaecke asked Engineer Hirsh to look into. There was additional concern expressed over Streeker Road intersection.  Mayor DeBaecke noted it was tight but it was engineered and would be looked into.  Deputy Mayor O’Donnell noted previous concerns and there were modifications made.

AUTHORIZING A CLOSED SESSION MEETING

 

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and

 

            WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and

 

            WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.  10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.

 

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Contract Matters, Litigation and Personnel matters.

 

            BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
