ENGINEER’S REPORT

Engineer Hirsh was not present this evening, but had submitted a written report.  Clerk Picariello noted item of interest was Engineer Hirsh sought permission from the County to use the remaining Park Grant funds for bathroom improvements.

2019-43           Resolution Approving a Blue Light Permit Application

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

 

APPROVAL OF BLUE LIGHT PERMIT APPLICATION

 

            WHEREAS, pursuant to N.J.A.C. 13:24-5 ET Seq. an applicant for permit authorizing the use of blue emergency warning lights may be considered eligible only if the applicant is an active member in good standing of a volunteer fire company, first aid or rescue squad, or a county or municipal Office of Emergency Management volunteer whose official duties include responding to a fire or emergency call; and

.

            WHEREAS, Jarrod Foster has met the qualification for a Blue Light Permit and it is the recommendation of the Fire Chief to approve this applicant for a Blue Light Permit.

 

            NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of North Hanover, County of Burlington, that in accordance with N.J.A.C. 13:24 et. seq. it hereby approve Jarrod Foster for a Blue Light Permit and hereby authorizes the Mayor to execute the Blue Light Permit Application.

 

            BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Jacobstown Volunteer Fire Department Chief.

2019-44           Resolution Rescinding Resolution 2019-1, in part, entitled “Resolution Authorizing Professional Services Agreements for the Year 2019 under the Fair and Open Process”

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

 

RESOLUTION RESCINDING RESOLUTION 2019-1, IN PART, ENTITLED “RESOLUTION AUTHORIZING PROFESSIONAL SERVICES AGREEMENTS

 FOR THE YEAR 2019 UNDER THE FAIR AND OPEN PROCESS”

 

WHEREAS on October 12, 2018, the Township of North Hanover published a notice for the solicitation of proposals for Professional Services Agreements for various professionals to be appointed by the Township Committee; and

 

WHEREAS the proposals were solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.4 et. seq.; and

 

WHEREAS after receiving said proposals, and after review, the Township Committee by Resolution 2019-1 adopted January 3, 2019 awarded various Professional Service Agreements for the calendar year 2019 to various professional firms, including a Professional Services Agreement to Capehart & Scatchard, P.A. as Bond Counsel; and

WHEREAS, by letter dated February 8, 2019, the Township Clerk was advised that the sole attorney employed by Capehart & Scatchard, P.A. specializing in public finance, was leaving the firm as of March 5, 2019; and

 

WHEREAS, as a consequence, Capehart & Scatchard, P.A. does not currently employ an attorney who specializes in public finance; and

 

WHEREAS, the Township’s CFO has advised that he does not anticipate that the Township will require a Bond Counsel in 2019; and

 

WHEREAS, as a result of the foregoing, the Township Committee has determined to rescind Resolution 2019-1 in part and only as it pertains to the appointment of Capehart & Scatchard, PA as Bond Counsel for the Township of North Hanover for calendar year 2019.

 

NOW THEREFORE BE IT RESOLVED by the Township Committee of North Hanover Township that it does hearby rescind Resolution 2019-1 in part such that the appointment of Capehart & Scatchard, PA as Bond Counsel for the Township of North Hanover for Calendar Year 2019, be and is hereby rescinded.

DISCUSSION

·        Recreation Sponsorship

Committeeman Kocubinski stated Alexandra DeGood was present tonight as she is in charge of Sponsorship on the Recreation Advisory Committee.  Clerk Picariello gave a brief overview of discussions last meeting.  Committeeman Kocubinski noted purchasing would be handled through the Township.  Alexandra stated the team sponsorship and sign sponsorship would remain separate until such time interest could be evaluated.  She noted it would be $350.00 per team to sponsor.  These funds would go to purchase uniforms and towards the awards banquet.  She noted there were 6 teams for baseball and that enrollment was up this year.  She noted there was a contingency plan should no one sponsor.  She noted a change in the sign sponsorship would be a whole year and no more half year sponsor.  She would like to reduce the fees somewhat to allow for smaller business’s to participate.  After discussion, there was a general consensus to move forward.

 

·        Updating Towing Ordinance

Clerk Picariello read the correspondence from USA Towing, as it relates to our current fees.   The last update was done in 2006.  After discussion, Clerk Picariello was instructed to notify Attorney Roselli to come up with a draft ordinance for consideration at a later date.

 

·        Summer Recreation Program

This item was post-poned until the meeting of March 7th due to the absence of Attorney Roselli.

AUTHORIZING A CLOSED SESSION MEETING

 

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and

 

            WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and

 

            WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.  10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.

 

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss PPA vs. Burlington County Board of Chosen Freeholders, Contract Matters, Litigation and Personnel matters.

 

            BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
