SUNSHINE STATEMENT: “The provisions of the Open Public Meetings Act have been met. Notice of this meeting has been transmitted by email to the Courier Post, Burlington County Times and The Trenton Times as well as given to those having requested same and posted on the Township bulletin board located in the foyer of the municipal building”.

MAYORAL PROCLOMATION PATRIOT DAY – Mayor DeBaecke noted his attendance at the September 11th Patriot Walk at the School. He read his proclamation into the record.
REVIEW OF CORRESPONDENCE

Elected Officials Liability Seminar – Clerk
Picariello noted the BCJIF has now rescheduled their meetings and it
interferes with Township Committee meetings.
There was a general consensus to cancel the meeting of December 5th
so the Township Committee could attend the elected official training.
A special meeting would be considered if the work load was in
need of one.

Clerk Picariello noted there was late
correspondence received from Northern Burlington School District.
She noted the Township Committee was invited to the ground
breaking. Committeeman
Kocubinski noted he would attend.
The rest of the Township Committee stated they would check their
schedule and let the Clerk know before the RSVP date.
ENGINEER’S REPORT Engineer Hirsh reported the one quote for the baseball field was received for the FY 2016 Municipal Park Grant. He noted the FY 2015/2016 NJDOT project was being closed out. He stated the FY2018 NJDOT project punch list was issued and he was awaiting a schedule from the contractor. He noted the FY2019 NJDOT project bids were received and the project award was on the agenda. He stated he was working on quotes for the various drainage issues.

WHEREAS, the United States Department of Veteran Affairs has classified David Abell as 100% Permanently and Totally Disabled; and
WHERAS, by application from Donald Kosul, Tax Assessor in the Township of North Hanover, the said exemption is granted from September 3, 2019; and
WHERAS, N.J.S.A. 54:4-3.30a – Allows for the exemption from taxation from real and personal property for any citizen and resident of the State who has a total or 100% permanent disability as defined by this statue.
WHEREAS, the following taxes must be canceled and any monies paid by the owner should be refunded.
THEREFORE BE IT RESOLVED, that the following taxes be canceled:

evidenced by the Chief Financial Officers certification of the
availability of funds.
NOW THEREFORE, BE IT RESOLVED
by the Township Committee of the Township of North Hanover, County of
Burlington County, State of New Jersey that an award is hereby issued to
Earle Asphalt Company with offices at PO BOX 556, Farmingdale, NJ 07727,
for NJDOT FY 2019 Road Improvement Program of Springfield Road located

PLAN’S TIER ONE REQUIREMENTS
Whereas,
the North Hanover
Township is a member of the
Burlington County Joint Insurance Fund which secures insurance
protection through the New Jersey Municipal Excess Liability Joint
Insurance Fund (NJ MEL); and
Whereas,
through its membership in the Burlington County Joint Insurance Fund,
the Township of North
Hanover enjoys cyber liability
insurance coverage to protect the Township of North Hanover from
the potential devastating costs associated with a cyber related claim;
and
Whereas,
in an attempt to prevent as many cyber related claims as possible, the
NJ MEL developed and released to its members the NJ MEL Cyber Risk
Management Plan; and
Whereas,
the NJ MEL Cyber Risk Management Plan outlines a set of best practices
and standards broken out into Tier 1 & Tier 2 standards that if adopted
and followed will reduce many of the risks associated with the use of
technology by the Township of North Hanover; and
Whereas,
in addition to the reduction of potential claims, implementing the
following best practices and standards will
enable the Township of North
Hanover to claim a reimbursement of a paid insurance deductible in the
event the member files a claim against
the Township of North
Hanover’s cyber insurance policy, administered through

recommendation of the Township’s Engineer that the Township of North
Hanover authorize the release of final payment on voucher in the total
amount of $61,313.79 to Arawak Paving Company, Inc.; and
WHEREAS, it is the intention
of the Township Committee to approve the release of final payment on
voucher in the amount referenced herein, in accordance with the Township
Engineer’s recommendations.

Township authorizes the release final payment on voucher in the total

A RESOLUTION RELEASING THE PERFORMARNCE
BOND FOR THE 2015 ROAD RESURFACING PROGRAM CONTRACT I AND ACCEPTING
MAINTENANCE BOND #0194889M
WHEREAS, Remington, Vernick and Arango Engineers, and Affiliates, Inc. has inspected the Arawak Paving Companies work with the 2015 Road Resurfacing Program Contract I in North Hanover Township, New Jersey; and
WHEREAS, the Township's Engineer has determined that the condition of the improvements is satisfactory; and
WHEREAS, the Township's Engineer has determined that the condition of the improvements is satisfactory, and with due regard to the passage of time; and
WHEREAS, it is the recommendation of the Township’s Engineer that the Township of North Hanover release the Berkley Insurance Company of Performance Surety Bond #0194889 , in the amount of One Million Two Hundred Twenty-three Thousand Eight Hundred Dollars and 00/100 cents ($1,223,800.00) and accept the Berkley Insurance Company two (2) year Maintenance Bond #0194889M4 in the amount of One Million Three Hundred Fifteen Thousand Six Hundred Eight-Nine Dollars and 53/100 cents ($1,315,689.53), provided that the release of the Performance Bond is contingent upon the payment of all outstanding escrow invoices.
WHEREAS, it is the intention of the Township Committee and in the best interest of the Township of North Hanover to release the Performance Bond and accept a two year Maintenance Bond in the amount referenced herein, contingent upon the payment of all outstanding escrow invoices, in accordance with the Township Engineer’s recommendations.
NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, that the performance bond #0194889 be released for the 2015 Road Resurfacing Program Contract I described above and accept a two (2) year maintenance bond of $1,315,689.53 as well.
BE IT FURTHER RESOLVED, that copies of this resolution shall be provided to the Finance Director, the Township Engineer, and Arawak Paving Company for their information and attention.

WHEREAS, the Township's Engineer has determined that the condition of the improvements are satisfactory; and
WHEREAS, it is the recommendation of the Township’s Engineer that the Township of North Hanover authorize the final payment on voucher in the total amount of $17,425.00, to Earle Asphalt Company; and
WHEREAS, it is the intention of the Township Committee to approve the payment on voucher in the amount referenced herein, in accordance with the Township Engineer’s recommendations.
NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, that the Township authorizes the release the final payment on voucher in the total amount of $17,425.00 to Earle Asphalt Company.

2019-123 Resolution Authorizing the Submission of the 2019 Burlington County Municipal Park Development Grant Application

RESOLUTION AUTHORIZING THE SUBMISSION OF THE 2019 BURLINGTON COUNTY
MUNICIPAL PARK DEVELOPMENT GRANT APPLICATION
WHEREAS,
the Burlington County Board of Chosen Freeholders has approved the Open
Space, Recreation, Farmland and Historic Preservation Trust Fund (“Trust
Fund”) and established a Municipal Park Development Program (“Program”)
to provide grant funds in connection with municipal acquisition of lands
for County park, recreation, conservation and farmland preservation
purposes, as well as for municipal public park and recreation
development purposes; and
WHEREAS,
the Governing Body of North Hanover Township, Burlington County, State
of New Jersey desires to obtain County Municipal Park Development
Program funds in the amount of $249,426.67
to fund Schoolhouse Road Park Improvements, Schoolhouse Road,
Jacobstown, New Jersey 08562, Block 501,Lots 18 and 36; and
WHEREAS,
the total cost of the project including all matching funds is estimated
to be
$249,426.67; and
WHEREAS,
the Township of North Hanover is the owner of and controls the project
site.
NOW, THEREFORE, BE IT RESOLVED BY The North Hanover Township Committee
that;
1.
Ronald DeBaecke Jr., Mayor, is authorized to (a) make an application to
the County of Burlington for Municipal Park Development Program Funds,
(b) provide additional application information and furnish such
documents as may be required for the Municipal Park Development Program
and (c) act as the municipal contact person and correspondent of the
above named municipality;
2.
The Township of North Hanover is committed to this project and will
provide the balance of funding necessary to complete the Schoolhouse
Road Park Project in the
form of non-county matching funds as required in the Policy and
Procedures Manual for the Program; and
3.
If awarded a grant by the County of Burlington under the Municipal Park
Development Program, the municipality will use the approved funds in
accordance with the Municipal Park Development Program Policy and
Procedure Manual, and applicable federal, state, and local government

Ronald DeBaecke Jr, Mayor, is hereby authorized to sign and execute any
required documents, agreements, and amendments thereto with the County
of Burlington for the approved Funds; and

DISCUSSION There were no discussion items this evening.
TOWNSHIP COMMITTEE “COMMENTS” Committeeman Kocubinski stated the Senior picnic was a success and it was enjoyed by all.
Committeeman Doyle offered his apologies for being late to the picnic but enjoyed it. He also expressed his gratitude to the armed services and first responders in remembrance of 911.
Committeeman DeLorenzo expressed the same sentiment and noted the picnic was enjoyable.
Deputy Mayor O’Donnell noted he authorized the JVFC to purchase to new power stretchers for the ambulances. This will be paid for out of the EMS fund at no cost to taxpayers.
Mayor DeBaecke noted his attendance at the schools Patriot Day celebration. He spoke at the assembly and walked with the students. He expressed pleasure with the Senior picinic. He stated the flu shot clinic would be held September 25th and the Community Yard Sale will be September 29th.

TOWNSHIP OF NORTH HANOVER
COUNTY OF BURLINGTON
AUTHORIZING A CLOSED SESSION
MEETING
WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and
WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.
NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Court Personnel Matter, Contract Matters, Litigation and Personnel matters.
BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
