Mayor Doyle noted an addendum to the Agenda this evening.  He stated Resolution 2021-44-A was being added to the non-consent Agenda.

ENGINEER’S REPORT

Engineer Hirsh stated the Schoolhouse Road survey has been postponed due to the weather.  He stated it was rescheduled for next week.  He stated the tentative schedule for Sykesville drainage was set for February 24th.  He noted he was working on quotes for the drainage repairs on Hanover Drive and expects to quote early March.

RESOLUTION CANCELING TAXES

 

            WHEREAS, the United States Department of Veteran Affairs has classified Brad DeVinney as 100% Permanently and Totally Disabled; and

 

            WHERAS, by application from Donald Kosul, Tax Assessor in the Township of North Hanover, the said exemption is granted from December 9, 2020; and

 

            WHERAS, N.J.S.A. 54:4-3.30a – Allows for the exemption from taxation from real and personal property for any citizen and resident of the State who has a total or 100% permanent disability as defined by this statue.

 

            WHEREAS, the following taxes must be canceled and any monies paid by the owner should be refunded.

 

            THEREFORE, BE IT RESOLVED, that the following taxes be canceled:

 

                        BLOCK 401 LOT 12                    2020                $   403.48

                                                                                    2021 1st Half            $3,458.71

 

THEREFORE, BE IT RESOLVED FURTHER, that a copy of this Resolution be forwarded to the Burlington County Board of Taxation, the Treasurer of Burlington County, the Municipal/Regional School Board to advise them of the action taken by the Township Committee on this matter.

2021-41            Resolution Authorizing Refund of Tax Sale Premium Due to Foreclosure

RESOLUTION AUTHORIZING REFUND OF TAX SALE PREMIUM DUE TO FORECLOSURE

 

            WHEREAS, Tax Sale Certificate #19-00001 was sold on October 24, 2019 and was foreclosed on January 19, 2021 by certificate holder Fidelity Asset Management, LLC; and

 

            WHEREAS, Fidelity Asset Management LLC paid a tax sale premium, in the amount of $8,000.00, for said Lien; and

 

            WHEREAS, in accordance with N.J.S.A. 54:5-33, if the certificate is redeemed within five years from the date of the sale, the premium will be returned to the purchaser of the certificate, if not redeemed, the premium payment is then paid over to the Treasurer of the Municipality as miscellaneous revenue not anticipated;

 

            THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover that, as requested by the Tax Collector, it hereby authorizes the return of tax sale premium, in the amount of $8,000.00 to the North Hanover Township Treasurer, for Lien 19-00001, Block 501 Lot 34, commonly known as 18 Jacobstown-Cookstown Road.

RESOLUTION ACCEPTING QUOTE FROM EARLE ASPHALT COMPANY FOR DRAINAGE IMPROVEMENTS ON SYKESVILLE ROAD

 

WHEREAS, the Township of North Hanover desires to make drainage improvements on Sykesville Road located in North Hanover Township; and

 

WHEREAS, N.J.S.A. 40A:11-6.1, authorizes the solicitation of quotations, if practicable; and

 

WHEREAS, the Township has reviewed the quotes received and recommends the lowest quote submitted by Earle Asphalt Company; and

 

WHEREAS, the Township of North Hanover has sufficient funding in place as evidenced by the Chief Financial Officers certification of the availability of funds.

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey hereby accepts the lowest quote by Earle Asphalt Company, for Drainage Improvements to Sykesville Road in the amount of $5,160.00.

 

BE IT FURTHER RESOLVED that the Chief Financial Officer is hereby authorized to issue said purchase order aforesaid on behalf of the Township.

2021-43           Resolution Authorizing an Extension to Contract by and between the Township of North Hanover and JB Lawn and Land Care, LLC for the Provision of Grass Cutting and Maintenance of North Hanover Township Property and Recreation Fields within the Township of North Hanover

RESOLUTION AUTHORIZING AN EXTENSION TO CONTRACT

BY AND BETWEEN THE TOWNSHIP OF NORTH HANOVER AND

JB LAWN AND LAND CARE, LLC FOR THE PROVISION OF GRASS CUTTING AND MAINTENANCE OF NORTH HANOVER TOWNSHIP PROPERTY AND RECREATION FIELDS WITHIN THE TOWNSHIP OF NORTH HANOVER

 

            WHEREAS, the Township of North Hanover (hereinafter “Township”) previously awarded by way of public bid by way of Resolution No. 2019-55 adopted March 21, 2019, a contract (hereinafter “Contract”) to JB Lawn and Land Care, LLC having an address at 1058 Provinceline, Allentown, NJ 08501 (hereinafter “Contractor”) for the provision of Grass Cutting and Maintenance services for the Township property and Recreation Fields for an initial term of April 1, 2019 to March 31, 2021; and

 

            WHEREAS, pursuant to the terms of the initial Contract and the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., the term of the Contract can be extended by the Township for up to two (2), one-year additional terms, under the same terms and conditions of the awarded contract, including price, unless a different price is accepted by the Township Committee in accordance with the requirements of the New Jersey Local Public Contracts Law; and

 

            WHEREAS, the Township Committee hereby finds that the services being provided by the Contractor are being performed in an effective and efficient manner; and

 

            WHEREAS, in accordance with the paragraph IV of the Contract, the Township wishes to extend the term of the Contract for an additional one-year term, commencing April 1, 2021 and terminating March 31, 2022 under the same terms and conditions, in effect under the contract of the April 1, 2019 until March 31, 2021 Contract; and

           

            WHEREAS, the Contractor has consented to the extension of the Contract under the same terms and conditions of the 2019/2021 contract, which was set forth in an agreement executed by the parties at $20,000.00;

           

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington, State of New Jersey that it does hereby authorize a one year extension to the Contract with JB Lawn and Land Care, LLC having an address at 1058 Provinceline Road, Allentown, NJ 08501 by extending the term of the contract for one year term; with the contract prices as set forth herein above; with all other terms and conditions of the contract remaining the same.

 

BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to JB Lawn and Land Care, LLC

2021-44           Resolution Memorializing Approval of Installation and Repayment Agreements with Public Service Electric and Gas

RESOLUTION 2021- 44

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

 

RESOLUTION MEMORIALIZING APPROVAL OF INSTALLATION AND REPAYMENT AGREEMENTS WITH PUBLIC SERVICE ELECTRIC AND GAS

 

WHEREAS, Public Service Electric & Gas (hereinafter “PSEG”) offers energy conservation programs in its electric and/or gas territory that are government entities with annual peak demands equal to or less than 200 kW; and

 

WHEREAS, the Township of North Hanover is a PSEG customer and qualifies for this program; and

 

WHEREAS, PSEG presented the Township will three proposals dated December 13, 2020 to install certain energy conservation measures in the Township Municipal Building, the Jeanette Bowers Community Center; and the Jacobstown Volunteer Fire and EMS building; and

 

WHEREAS, pursuant to the proposal and the conservation program, the Township agreed to have a PSEG designee, that being Tri-State Light & Energy, Inc. perform the necessary work to install the energy conservation measures; and

 

WHEREAS, pursuant to the terms of the Installation and Repayment Agreement, the Township is required to contribute 30% of the total project cost for each project as its contribution to the work being performed, which will be paid over thirty-six months, interest free, through an additional charge on the Township’s PSEG utility bill, upon completion of the work; and

 

WHEREAS, the Township received three proposals as follows: (1) Jacobstown Volunteer Fire and EMS Building – total project cost of $18,214.28; (2) Township Municipal Building – total project cost of $57,984.94; and (3) Jeanette Bowers Community Center – total project cost of $29,115.99; and

 

WHEREAS, the Township Committee, being of the belief that the program and the installation of the energy conservation measures, were in the best interest of the Township and are improvements that over time, with cost savings associated with the improvements, will pay for Township’s contribution to the cost of same, voted at its January 21, 2021 meeting to approve the contracts and authorize the Mayor to execute same on behalf of the Township of North Hanover; and

 

WHEREAS, the purpose of this resolution is to memorialize the Township Committee’s voice vote approving the contracts and authorizing the Mayor to execute the three contracts with PSEG for the services outlined hereinabove.

 

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover that it does hereby approve of the three Installation and Repayment Agreements with Public Service Electric & Gas for the installation of energy conservation measures at the Municipal Building, the Jeanette Bowers Community Center and the Jacobstown Volunteer Fire and EMS Building and by this resolution, the Township Committee does hereby memorialize its approval of the agreements and its authorizing the Mayor to execute said agreements on behalf of the Township of North Hanover.

ADDENDUM

RESOLUTION 2021-44-A

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

 

A RESOLUTION AUTHORIZING THE TOWNSHIP OF NORTH HANOVER TO ENTER INTO A COOPERATIVE PRICING AGREEMENT

 

                WHEREAS, N.J.S.A. 40A:11-11 authorizes contracting units to establish a Cooperative Pricing Agreement for its administration; and

 

                WHEREAS, the County of Burlington, hereinafter referred to as “Lead Agency,” has offered voluntary participation in a Cooperative Pricing System for the purchase of goods and services; and

 

                WHEREAS, on February 4, 2021, the governing body of the Township of North Hanover, County of Burlington, State of New Jersey, duly considered participation in a Cooperative Pricing System for the provision and performance of goods and services.

 

                NOW, THEREFORE, BE IT RESOLVED as follows:

TITLE

 

This RESOLUTION shall be known and may be cited as the Cooperative Pricing Resolution of the Township of North Hanover.

AUTHORITY

 

                Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor and Municipal Clerk are hereby authorized to enter into a Cooperative Pricing Agreement with the Lead Agency.

CONTRACTING UNIT

 

The Lead Agency shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of the State of New Jersey.

EFFECTIVE DATE

 

This resolution shall take effect January 1, 2021.

DISCUSSION

There were no items for discussion this evening.

 

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Forsyth noted the snow contractor did a good job with the storm.  He noted he helped out with the storm and wanted to make sure everyone was fine with him helping.  There was a general consensus to allow and the Committee thanked Committeeman Forsyth.

 

Deputy Mayor DeBaecke thanked the snow contractor and noted they did a good job.  He thanked Committeeman Forsyth for his work.

 

Mayor Doyle stated the blood drive was scheduled, at the JVFC, on February 16th.  He noted he would be attending a virtual seminar on February 9th, regarding over burden communities.  He also apologized for the inconvenient closing of the waste facility on Tuesday, due to the storm.  He thanked Committeeman Kocubinski, whom would be attending a JBMDL virtual seminar, on March 1st, on his behalf.  He offered prayers to the recently deceased FBI Agents and the US Marshall who was shot in Maryland.

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and

 

            WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and

 

            WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.  10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.

 

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Plumsted EMS Contract matter, Police Contract matter, NJNG Contract matter, contract Matters, Litigation and Personnel matters.

 

            BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
