ENGINEER’S REPORT
Engineer Hirsh reported the
new parking lot on Schoolhouse Road would be graded and topsoil and seed
operation would be completed next week.
He stated the FY2020 NJDOT project milling will begin tomorrow. He also stated he was awaiting pricing on the
additional sidewalk. He noted an
inspection at 141 Meany Road he noted the piping appears to be in good
condition but the roadway appears to settling above the pipe. He will monitor. Engineer Hirsh stated he was still awaiting
confirmation from contractor in a repair date for the gutters at Municipal
Building.

AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, BURLINGTON
COUNTY, NEW JERSEY PROVIDING FOR LOCAL ENFORCEMNT OF THE NEW JERSEY FIRE CODE
WHEREAS,
the Uniform Fire Safety Act, (P.L. 1983, c.383) was enacted for the purpose of
establishing a system for the enforcement of minimum fire safety standards
throughout the State of New Jersey; and
WHEREAS,
the New Jersey Department of Community Affairs has promulgated minimum fire
safety standards which have been made part of the Uniform Fire Code (N.J.A.C.
5:70.1 et seq.); and
WHEREAS,
the Uniform Safety Act authorizes municipalities to provide for local
enforcement of these standards and to establish local enforcement agencies for
that purpose; and
WHEREAS, it is in the best interest
of the Township of North Hanover to have the Uniform Fire Code enforced
locally.
NOW THEREFORE BE IT ORDAINED by the Township Committee of
the Township of North Hanover in the County of Burlington and State of New
Jersey, as follows:
SECTION 1. ENFORCMENT OF
UNIFORM FIRE CODE
A. LOCAL
ENFORCEMENT
Pursuant to Section 11 of the
Uniform Fire Safety Act (P.L. 1983, c.383), the New
Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.) shall be locally
enforced in the
Township of North Hanover.
B. AGENCY DESIGNATION
The local enforcing agency
shall be the Township Bureau of Fire Prevention which
is hereby created therein. The Bureau of Fire Prevention shall hereinafter be known as the local
enforcing agency.
C. DUTIES
(1) The local enforcing agency shall enforce the Uniform Fire
Code in all buildings, structures, and premises
with the established boundaries of the Township of North Hanover, other than
one- and two-unit owner-occupied dwellings used exclusively for
dwelling purposes and buildings, structures, and premises
owned or operated by federal government, intestate agencies, or the state.
(2) The local enforcing agency shall faithfully
comply with all pertinent requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.
D. ORGANIZATION
(1) The Bureau of Fire Prevention established by this article
shall be under the direct supervision and control of a Fire Official who shall be appointed
by and report to the Township Committee.
(2) The Bureau of Fire Prevention shall have
at least one paid Fire Official and such paid inspectors as may be
necessary to properly enforce the Uniform Fire
Code.
(3) The Township Committee shall hereby be
permitted to appoint a temporary Fire Official in the
absence of duly appointed Fire Official.
E. APPOINTMENTS, QUALIFICATIONS, TERMS OF OFFICE, REMOVAL
(1) Appointment and Qualification of the Fire Official. The Fire
Official shall be certified by the State and
appointed by the Township Committee.
(2) Appointment and qualification of
inspectors and other employees. Inspectors and other employees of
the local enforcing agency shall be appointed by
the Township Committee upon recommendation of the Fire Official. All life hazard
inspectors shall be certified by the State.
(3) Removal from office. The Fire Official,
inspectors and other employees of the local enforcing agency shall be
subject to removal by the Township Committee pursuant to any applicable
state or federal law, or local ordinances.
F. LIFE HAZARD USES
The Bureau of Fire Prevention
established herein shall carry out the periodic inspections
of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner
of the Department of Community Affairs.
G. NON-LIFE HAZARD USES
(1) In addition to the registrations required by the Uniform
Fire Code, non-life hazard uses shall also register with
the North Hanover Township Bureau of Fire Prevention. These uses shall be
inspected once per year and pay an annual fee as set forth below:

(2) Failure to pay the required annual
non-life-hazard use registration fee(s) within 60 days from the date of issuance
will result in the issuance of a written order by the Fire Official
to make such payment in addition to the imposition of a penalty in an amount equal to the unpaid
fee(s). These penalties will be in addition to non-life-hazard use fee(s) due and must be paid within
30 days after issuance by the Fire Official of the written order to abate the
violation and pay the penalty. If the total fee(s) and penalties are not paid within 30 days of
the issuance of the written order, the Fire Official may institute a civil penalty action by
a summary proceeding in the North Hanover Township Municipal Court or New Jersey
Superior Court under the New Jersey Penalty Enforcement Law of 1999, N.J.S.A. 2A:58-10
et seq., and this section.
F. PERMITS AND
CERTIFICATE OF FIRE CODE STATUS
(1) The application fees for permits listed in N.J.A.C.
5:70-2.7 (b) shall be as provided by State regulation.
(2) The cost for the issuance of certificate
of Fire Code status shall be $35.
H. FEES FOR SMOKE DETECTOR AND CARBON MONOXIDE ALARMS
Fees for certificate of smoke
detector and carbon monoxide (CSCCMAC), as required by N.J.A.C. 5:70-2.3, shall
be based upon the amount of time remaining before the change of occupant is
expected, as follows:
(1) Requests for CSDCMAC received more than
10 business days prior to change of occupant:
$35.00.
(2) Requests for a CSDCMAC received four to
10 business days prior to the change of occupant:
$70.00.
(3) Requests for a CSDCMAC received fewer
than four business days prior to the change of occupant:
$125.00.
I. BOARD OF APPEALS
Pursuant to §§15 and 17 of
the Uniform Fire Safety Act, any person aggrieved by any
action of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Burlington County.
J. ENFORCEMENT, VIOLATIONS, AND PENALTIES
Enforcement, violations, and
penalties shall be as established in conformity with the
Uniform Fire Safety Act, the Uniform Fire Code and all other laws of the State of New
Jersey.
SECTION 2. All ordinances or parts of ordinances inconsistent with or in
conflict with this ordinance are hereby repealed to the extent of such
inconsistency.
SECTION 3. If
any section, paragraph, subdivision, clause or provision of this Ordinance
shall be adjudged invalid, such adjudication shall apply only to the section,
paragraph, subdivision, clause or provision so adjudged and the remainder of
the Ordinance shall remain valid and effective.
SECTION
4. This ordinance shall take effect
immediately upon final passage and publication according to law.

AMENDING THE TOWNSHIP CODE OF THE TOWNSHIP OF NORTH HANOVER BY CREATING THE
PART-TIME POSITIONS OF “FIRE OFFICIAL” AND “FIRE INSPECTOR” AND ESTABLISHING
REQUISITE DUTIES, RESPONSBILITIES AND SALARY RANGES FOR SAID POSITIONS
WHEREAS the Township Committee of the Township of North Hanover believes
that it is in the best interest of the Municipality to create new part-time
positions entitled “Fire Official” and “Fire Inspector” for the North Hanover
Township Bureau of Fire Prevention; and
WHEREAS, the Township Committee further desires to establish the duties,
responsibilities, and salary range for said positions.
NOW THEREFORE, BE IT ORDAINED by the Township Committee of the Township
of North Hanover as follows:
SECTION 1. The positions
of “Fire Official” and “Fire Inspector” be and are hereby established as
part-time positions and the salary ranges of the employee appointed to said
positions are hereby fixed in the following schedule, subject to appointment by
resolution of the Township Committee:

SECTION 2: Duties and
Responsibilities: The Fire Official shall be appointed by and report to the
Township Committee and shall be responsible for the supervision and control of
the North Hanover Township Bureau of Fire Prevention. The Fire Official shall
ensure that inspectors or other employees that may be employed to work within
the Bureau of Fire Prevention have the requisite certifications, where
required, and necessary work experience. The Fire Official shall ensure that
the Bureau of Fire Prevention is complying with all pertinent requirements of
the Uniform Fire Safety Act and Uniform Fire Code. The Township Committee shall
appoint the Fire Inspector, upon recommendation of the Fire Official. The Fire
Inspector shall conduct such inspections as required and at the direction of
the Fire Official. Such inspections shall be conducted in accordance with the
requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
SECTION 3. All Ordinances inconsistent
with the above are hereby repealed.
SECTION 4. This Ordinance and the
salaries herein are subject to all federal laws, rulings, and guidelines
concerning prices and wages.
SECTION 5. This Ordinance shall take
effect immediately after its final passage and publication according to law.

TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS
AND TO
ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government CAP Law,
N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual
budget, a municipality shall limit any increase in said budget to 2.5%
unless authorized by ordinance to increase it to 3.5% over the previous year’s final
appropriations, subject to certain exceptions; and
WHEREAS, N.J.S.A. 40A: 4-45.15a
provides that a municipality may, when authorized by ordinance, appropriate the
difference between the amount of its actual final appropriation and the 1.0%
percentage rate as an exception to its final appropriations in either of the
next two succeeding years; and
WHEREAS, the Township Committee of the
Township
of North Hanover in the County of Burlington finds
it advisable and necessary to increase its CY 2022 budget by up
to 3.5% over the previous year’s final appropriations, in the
interest of promoting the health, safety and welfare of the citizens; and
WHEREAS, the Township Committee of the
Township
of North Hanover in the County of Burlington hereby
determines that a 1.0%
increase in the budget for said year, amounting to $27,772.67
in excess of the increase in final appropriations otherwise permitted by the
Local Government CAP Law, is advisable and necessary; and,
WHEREAS, the Township Committee of the
Township
North Hanover of in the County of Burlington hereby
determines that any amount authorized herein above that is not appropriated as
part of the final budget shall be retained as an exception to final
appropriation in either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Township Committee of the
Township
of North Hanover in the County of Burlington, a
majority of the full authorized membership of this governing body affirmatively
concurring, that, in the CY 2022 budget year, the final
appropriations of the Township of North Hanover shall, in
accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%,
amounting to $97,204.35, and that the CY 2022
municipal budget for the Township of North Hanover
be approved and adopted in accordance with this ordinance; and
BE IT FURTHER ORDAINED, that any amount authorized
herein above that is not appropriated as part of the final budget shall be
retained as an exception to final appropriation in either of the next two
succeeding years; and
BE IT FURTHER ORDAINED, that a certified copy of this
ordinance as introduced be filed with the Director of the Division of Local
Government Services within 5 days of introduction; and
BE IT FURTHER ORDAINED, that a certified copy of
this ordinance upon adoption, with the recorded vote included thereon, be filed
with said Director within 5 days after such adoption.

RESOLUTION AUTHORIZING DISPOSAL OF EXCESS MUNICIPAL PROPERTY NO LONGER
NEEDED FOR PUBLIC USE
WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-36 authorizes the sale or other disposition of surplus municipal property no longer need for public use when authorized by resolution duly adopted by the governing body; and
WHEREAS, N.J.S.A. 40A:11-36 (6) further provides that if the estimated fair value of property to be sold does not exceed the applicable bid threshold in any one sale, the property may be sold at private sale without advertising for bids; and
WHEREAS, the Township Committee desires to dispose of said surplus property identified herein by way of private sale as the estimated fair value of same does not exceed the applicable bid threshold.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, in the County of Burlington, State of New Jersey that it does hereby authorize the disposal by way of private sale and without advertising for bids the following Township personal property no longer needed for public use because the estimated fair value of the property does not exceed the applicable bid threshold in any one sale:

WHEREAS, N.J.S.A.
40A:4-5 as amended by P.L. 2017, c.183 requires the governing body of each
municipality and county to certify that their local unit’s hiring practices
comply with the United States Equal Employment Opportunity Commission’s
“Enforcement Guidance on the Consideration of Arrest and Conviction Records in
Employment Decisions Under Title VII of the Civil Rights Act of 1964,” as amended, 42
U.S.C. § 2000e et seq., (April 25, 2012)
before submitting its approved annual budget to the Division of Local
Government Services in the New Jersey Department of Community Affairs; and
WHEREAS,
the members of the North Hanover Township Committee have familiarized

THEREFORE BE IT RESOLVED, That the Township Committee of the Township of North Hanover,
hereby states that it has complied with N.J.S.A. 40A:4-5, as amended by
P.L. 2017, c.183, by certifying that the local unit’s hiring practices comply

COUNTY OF BURLINGTON
RESOLUTION INCREASING DEFERRED LOCAL SCHOOL TAX
WHEREAS, under the provisions of
statute, when a municipality raises school taxes on a school year basis, an
amount of not more than fifty percent of the levy may be deferred to the following
year, providing no requisition has been made for such amount or any portion of
such amount; and
WHEREAS, the North Hanover Township School District tax is levied on a school
year basis; and
WHEREAS, fifty percent of the school
tax levy of the North Hanover Township
School District levied by the Township
of North Hanover in 2021 is $ 1,606,890.00; and
WHEREAS, $ 1,575,362.00 of the above amount has
previously been deferred, leaving an available balance of $ 31,528.00 to be deferred.
NOW, THEREFORE, BE IT RESOLVED that the governing body of
the Township of North Hanover hereby
desires to defer additional school district tax in the amount of
$
31,507.50 for
the year 2021.

RESOLUTION AUTHORIZING APPROPRIATION RESERVE TRANSFER
WHEREAS N.J.S.A. 40A:4-59 provides for
appropriation transfers during the first 3 months of any fiscal year, when it
is determined that it is necessary to expend for any of the purposes specified
in the budget an amount in excess of the sums appropriated therefor and where
it has been further determined that there is an excess in any appropriation
over and above the amount deemed to be necessary to fulfill the purpose of such
appropriation; and
WHEREAS the Chief Financial Officer has
recommended that the attached list of transfers, being in compliance with
N.J.S.A. 40A:4-58, be made.
NOW THEREFORE BE IT RESOLVED by the
Township Committee of the Township of North Hanover, County of Burlington, (not
less than 2/3 of the full membership concurring affirmatively) that the 2021
budget transfers be made a permanent part of this resolution, are hereby made
and approved.

RESOLUTION AUTHORIZING AWARD OF BID FOR ROAD AND GROUND
SERVICE MAINTENANCE SUPERVISION CONTRACT
WHEREAS, North Hanover Township seeks
to award a contract for Road and Ground Service Maintenance Supervision
Services; and
WHEREAS, North Hanover Township hereby
accepts and approves the specifications of these services as prepared by the
Township Attorney, and finds this contract to be in the best interest of the
Township; and
WHEREAS,
on March 15, 2022 North Hanover Township received bids for Road and Ground
Service Maintenance Supervision Services; and
WHEREAS,
on that date, the lowest bids for the Base Bid were received from the following
bidders for this project:
1. Dittmer’s Nursery LLC $58,600.00
WHEREAS, the Public Works
Commissioner has recommended that the contract Road and Ground Service
Maintenance Supervision Services for the base bid be awarded Dittmer’s Nursery,
LLC in the amount of $58,600.00, and subject to the Township Attorney as to
form and completeness; and
WHEREAS, if applicable, the Chief
Financial Officer has certified the availability of funds.
NOW, THEREFORE, BE IT
RESOLVED, by
the Mayor and Township Committee of North Hanover Township, County of
Burlington, New Jersey that the contract for Road and Ground Service
Maintenance Supervision Services for the base bid be awarded to Dittmer’s
Nursery, LLC in the amount of $58,600.00 subject to the approval of the Township
Attorney and that the Mayor and Township Clerk are hereby authorized to execute
the contract on behalf of the Township.

Township Committee of North Hanover Township wishes to go into a closed
Executive Session and is of the opinion that such circumstances presently exist
which should not be discussed in public, and
WHEREAS. the
Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to
discuss certain matter(s) in private, and in this case for the purpose of the
Township Committee to discuss contract negotiations, litigation and personnel
matters in this regard.
NOW,
THEREFORE, BE IT RESOLVED
by Township Committee of North Hanover Township that it will go into an
Executive Session for the purpose of the Township Committee to discuss Fire
Official Personnel Matter, FOP Collective Bargaining Agreement, Contract
Matters, Litigation and Personnel matters.
BE IT FURTHER
RESOLVED that the results of such discussion may be revealed at such time
as the matter(s) are resolved and/or a contract(s) is signed and/or the
negotiations are formally settled. Interested parties may contact the Township
Clerk anytime during normal business hours for periodic updates as to the
availability in this regard.
