SUNSHINE STATEMENT: “The provisions of the Open Public Meetings Act have been met. Notice of this meeting has been transmitted by email to the Courier Post, Burlington County Times and The Trenton Times as well as given to those having requested same and posted on the Township bulletin board located in the foyer of the municipal building”.

 

At this time Mayor Doyle called for a vote on Resolution 2022-115

 

CEREMONIAL SWEARING IN OF CHIEF OF POLICE ROBERT DUFF

 

Committeeman DeBaecke asked Sergeant Duff and his family to come forward for the swearing in.  Committeeman DeBaecke welcomed Chief Duff’s family and noted Sergeant Duff began his career with the North Hanover Township Police Department in 1998.  He noted he was the longest continuing serving Officer.  He stated Chief Duff was the most sincere and dedicated Officer to this Community.  He noted it was an honor to be swearing him in.  Mayor Doyle stated as a retired police officer, police work was a lot more than conducting motor vehicle stops.  He stated you must have pride, perseverance, resolve, loyalty, honor and dedication.  You must care for everyone regardless of race, ethic background or religion.  He stated Chief Duff has always had warmth for this Community and he is proud to say congratulations to his family.  He noted without them Chief Duff would not be where he is today.  The love and support of family and friends help the Officer be successful.  He thanked Chief Duff and his family.  He Thanked the Police Department and their families.  He noted it was very tough today to be a Police Officer.  Chief Duff noted he was humbled by the turnout and expressed appreciation for their support.  He thanked his family for their support over the years.  He thanked the former and current Township Committee’s for their faith in him.  He thanked his former Chiefs, Larry Hopkins, Mark Keubler and Budd Wells.  He expressed appreciation for his first partner, Ed Mason and Sergeant Dennis Toomey, whom surprised him this evening.  He thanked the Residents of North Hanover.  He thanked everyone for coming.

REVIEW OF CORRESPONDENCE

1.      NJDEP notification of Reassignment from a Tier B to Tier A municipality under NJPDES permit program – Clerk Picariello noted North Hanover’s new assignment to a Tier A Municipality under the NJDEP Stormwater management program.  Engineer Hirsh stated he was reviewing procedures and would report back.  He stated it was due to contamination of down stream waters.  He noted the NJDEP wanted more regulated activities.  He noted street sweeping and drain cleaning are part of it.  He stated he would issue a memorandum concerning the requirements at a later date.  The first step is the application for the Tier A permit.  He noted 3 of his Town’s got this letter.

 

ENGINEER’S REPORT

Engineer Hirsh stated the grading and seed work was complete at the new parking lot.  He stated he would get the contractor back in the fall.  He noted the Tier A assignment from the NJDEP.  He had no update on the FY2019 Municipal Park Grant.  The NJDOT FY2020 project was scheduled to survey the intersection last week and he has been unable to confirm completion.  He noted he was still awaiting approval to bid the NJDOT FY2022 project.  He stated the NJDOT FY23 application was submitted.  He stated the Stewart Road inlet work was completed and he is still awaiting a Resolution to the Upper Freehold issue.  Mayor Doyle inquired if new cushions for the park machines could be looked into.  Engineer Hirsh said he would report back.

FOR NORTH HANOVER TOWNSHIP

 

WHEREAS, there currently exists a vacancy in the position of Chief of Police for the Township of North Hanover by reason of the retirement of the prior Chief of Police; and

 

WHEREAS, the Township Committee is desirous of filling that vacancy with the appointment of Chief of Police; and

 

WHEREAS, in accordance with the Township’s Promotional Policy for Chief of Police for the North Hanover Township Police Department (hereinafter “Promotional Policy”), only one officer, Sergeant Robert Duff, currently possesses the necessary qualifications to be appointed Chief of Police; and

 

WHEREAS, Sergeant Robert Duff has been serving as Officer in Charge since the retirement of the prior Police Chief and the Township Committee, as the Appropriate Authority, has determined that it would be appropriate to formally appoint Sergeant Robert Duff to the position of Chief of Police.

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey that it does hereby appoint Robert Duff as Chief of Police of the Township of North Hanover Police Department effective as of July 1, 2022, at an annual salary of $102,500.00, and subject to the terms and conditions of all applicable Township Personnel Policies, Employee Handbook and Township ordinances that pertain to the position of Police Chief; and

2022-117         Resolution Designating Conditional Redeveloper and Authorizing the Execution of a Conditional Redeveloper Designation and Escrow Agreement for Block 602 Lot 9.02 (Formerly Lot 9)  within the Redevelopment Study Area

COUNTY OF BURLINGTON, STATE OF NEW JERSEY

 

            RESOLUTION DESIGNATING A CONDITIONAL REDEVELOPER AND AUTHORIZING THE EXECUTION OF A CONDITIONAL REDEVELOPER DESIGNATION AND ESCROW AGREEMENT FOR BLOCK 602, LOT 9.02 (FORMERLY LOT 9) WITHIN THE REDEVELOPMENT STUDY AREA

 

WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the “Redevelopment Law”) authorizes municipalities to determine whether certain parcels of land located therein constitute an area in need of redevelopment; and

           

WHEREAS, on October 16, 2003, the Township Committee of North Hanover Township adopted Resolution #2003-108, directing the Joint Land Use Board to undertake a preliminary investigation to determine whether the properties identified as Block 600, Lots 1, 2, 4, 5; Block 601, Lots 401, 8, 9; Block 602, Lots 1-3, 7-9, 12-16; Block 605, Lot 1; Block 606, Lot 1; Block 607, Lot 1; Block 608, Lots 1, 2, 5, 7, 8; Block 609, Lots 2-7; Block 900, Lots 1-5; Block 901, Lots 1, 1.01, 2 and 5; and Block 902, Lots 1-4, 2.01, 24-25 (collectively referred to as the "Redevelopment Study Area") qualified as an area in need of redevelopment pursuant to the Redevelopment Law; and

 

WHEREAS, in response to Resolution #2003-108, the Joint Land Use Board engaged in the preparation of a preliminary investigation and because of their investigation, the Joint Land Use Board recommended that Block 602, Lots 10, 11; Block 610, Lots 17-18, 23-27 be added to the Redevelopment Study Area study; and

 

WHEREAS, based upon the Joint Land Use Board recommendation, the Township Committee adopted Resolution 2005-89 on September 28, 2005, and agreed to expand the study area to include the additional parcels; and

 

WHEREAS, the Township Committee received and reviewed a preliminary investigation study of the Redevelopment Study Area, including the additional lots, and the report and recommendations of the Joint Land Use Board, pursuant to Joint Land Use Board Resolutions 2005-10 and 2005-17, finding that certain areas within the Redevelopment Study Area, including Block 602, Lot 9 (now Lot 9.02) qualified as areas in need of redevelopment  according to the criteria set forth in N.J.S.A. 40A;12A-5 et seq., and as more fully detailed in the Wrightstown Sykesville Road Redevelopment Study dated May 5, 2005 and prepared by Remington & Vernick Engineers, Inc.; and

 

WHEREAS, by Resolution 2005-105, the Township Committee accepted the recommendations of the Joint Land Use Board and on October 6, 2005, designated multiple blocks and lots within the Redevelopment Study Area as areas in need of redevelopment, including Block 602, Lot 9.02 (formerly designated as Lot 9); and

 

WHEREAS, representatives of the owner of Block 602, Lot 9.02 (hereinafter the “Redevelopment Property”) made various presentations and proposals to the Township Committee regarding the proposed redevelopment of the Redevelopment Property, and the Township Committee has reviewed the proposals and has determined that in accordance with the Redevelopment Law, it is necessary and appropriate to designate North Hanover Urban Renewal, LLC as Conditional Redeveloper for the Redevelopment Property; and

           

WHEREAS, the Township Committee further desires to authorize the negotiation and execution of a conditional redeveloper designation and escrow agreement ("Conditional Redeveloper Agreement") with the Conditional Redeveloper for the purpose of establishing a framework for the negotiation and execution of a redevelopment agreement.     

 

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington and the State of New Jersey, as follows:

 

            1.         The foregoing recitals are hereby incorporated by reference as if fully repeated herein.

 

2.         North Hanover Urban Renewal, LLC is hereby conditionally designated as Conditional Redeveloper of the Redevelopment Property within the Redevelopment Study Area pending the negotiation, approval by vote of the Township Committee and execution of a redevelopment agreement with the Township of North Hanover.

 

3.         The within designation is expressly contingent upon the execution of a Conditional Redeveloper Agreement and in accordance with the terms thereof and is also made for a limited period of one hundred twenty (120) days, unless extended by the Township Committee.

 

4.         The Mayor is authorized to execute the Conditional Redeveloper Agreement subject to final negotiation of the form of same, with such changes, omissions or amendments as the Township Attorney deems appropriate in consultation with the Township’s professionals.

RECOGNIZING BURLINGTON COUNTY PROFESSIONAL FIREFIGHTERS ASSOCIATION IAFF LOCAL 3091 AS BARGAINING AGENT FOR TOWNSHIP’S EMS EMPLOYEES

 

WHEREAS, the Township of North Hanover determined to provide Emergency Medical Services for the provision of emergency medical transport and related medical services utilizing full and part-time employees of the Township; and

 

WHEREAS, the Township received notification from Burlington Cunty Professional Firefighters Association IAFF Local 3091 by Memorandum dated May 4, 2022 that a super majority of the EMS employees voted to join the Burlington County Professional Firefighters Association IAFF Local 3091 and requested that the Township Committee voluntary accept this determination and recognize IAFF Local 3091 as the exclusive bargaining agent for all full-time and part-time EMS employees of the Township, designated as Shop 46E; and

 

WHEREAS, the Township Committee has determined that it would be appropriate to formally recognize this determination by adoption of resolution.

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey that it does hereby recognize the Burlington County Professional Firefighters Association IAFF Local 3091 as the exclusive bargaining agent for all full-time and part-time EMS employees of North Hanover Township.

 

BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to Matthew Taylor, Shop Steward for Shop 46E and Robert Carr, Jr., President, Burlington County Professional Firefighters Association IAFF Local 3091

2022-119         Resolution Amending Professional Services Contract for Roselli Griegel Lozier & Lazzaro, PC

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

 

AMENDING PROFESSIONAL SERVICES AGREEMENT WITH MARK ROSELLI, ESQ. OF ROSELLI GRIEGEL LOZIER & LAZZARO, PC

 

WHEREAS, the Township Committee previously awarded a Professional Services Agreement to Mark Roselli, Esq. of Roselli Griegel Lozier & Lazzaro, PC for calendar year 2022 by Resolution 2022-01 adopted January 6, 2022; and

 

WHEREAS, pursuant to said agreement, the Township agreed to compensate Mark Roselli, Esq. at an hourly rate of $170 per hour for regular legal services related to general operations of the municipality; and

 

WHEREAS, the Township will require legal services related to redevelopment projects within the Township that requires a heightened level of expertise for which Mark Roselli, Esq. should be compensated at an hourly rate commensurate with that level of expertise; and

 

WHEREAS,  the Township Committee desires to amend the Professional Services Agreement with Mark Roselli, Esq. of Roselli Griegel Lozier & Lazzaro, PC to establish an hourly rate of $200 per hour for all redevelopment related work performed by Attorney Roselli on behalf of the Township, whether billed to the Township or to any escrow established by a redeveloper for a redevelopment project.

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey that the Professional Services Agreement by and between the Township of North Hanover and Mark Roselli, Esq. of Roselli Griegel Lozier & Lazzaro, PC shall be amended by including in paragraph 3 (a) an hourly rate of $200 per hour for all legal services related to redevelopment within the Township, whether billed to the Township or to an escrow established by a redeveloper.

 

BE IT FURTHER RESOLVED the Mayor and Municipal Clerk are hereby authorized to execute an amendment to the Professional Services Agreement with Mark Roselli, Esq. of Roselli Griegel Lozier & Lazzaro, PC incorporating the hourly rate for redevelopment related legal services.

2022-120         Resolution Authorizing Contract with Signature Flooring for Flooring and Other Improvements to the Municipal Building

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON

RESOLUTION AUTHORIZING CONTRACT WITH SIGNATURE FLOORING FOR FLOORING AND OTHER IMPROVEMENTS TO THE MUNICIPAL BUILDING

 

WHEREAS, the Township of North Hanover requires the services of a contractor for purposes of carpeting and making other necessary improvements to the Municipal building; and

 

WHEREAS, the Township Committee has determined and certified in writing that the value of the contract will not exceed $17,500; and

 

WHEREAS, the Township Committee has solicited competitive quotations of the service required and have determined that the proposal from Signature Flooring is the most advantageous, price and other factors considered; and

 

            WHEREAS, it is the desire of the Township Committee to accept the proposal from Signature Flooring for flooring and other improvements to the Municipal building in an amount not to exceed $12,703.00; and

 

            WHEREAS, funds are available to accept said proposal, as evidenced by the attached Certification of Availability of Funds;

 

            NOW, THEREFORE, BE IT RESOLVED, by the Township of North Hanover that it does hereby accept the proposal from Signature Flooring and it does hereby authorize a contract in an amount not to exceed $12,703.00 for flooring and other improvement services for the Municipal building.

 

BE IT FURTHER RESOLVED that the required “Notice of Contract Awards” shall be published in the legal newspaper as required by law within ten (10) days of its passage.

·         NJLM Conference – Clerk Picariello noted November 15th-17th.  The Committee directed Clerk Picariello to book two nights.

 

TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski noted Chief Duff’s appointment was well deserved.

 

Committeeman DeBaecke acknowledge the Country Fair and stated it was good start and hopes they continue to build on it.  He offered congratulations to Chief Duff.

 

Mayor Doyle noted the County Fair was a good event and also hopes it continues to expand.  He noted the Movie Night and Fireworks is scheduled for September 17th.  He offered congratulations to Chief Duff and hoped everyone was having a nice summer.

AUTHORIZING A CLOSED SESSION MEETING

 

WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and

 

            WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and

 

            WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A.  10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.

 

NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Contract Matters, Litigation and Personnel matters.

 

            BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
