REVIEW OF CORRESPONDENCE
County of Burlington Community Development Program – Clerk Picariello noted North Hanover was not selected for the grant.
State of New Jersey Pinelands Commission review of Ordinance 2023-02 – Clerk Picariello noted the Commission review stated the Ordinance was in conformity.
Clerk Picariello also stated North Hanover was awarded a grant, from the NJDEP, for Stormwater compliance assistance.
ENGINEER’S REPORT
Engineer Hirsh noted the RFQ was issued for the inlet repair at 609 Hanover Drive and was due May 26th. He stated the FY2019 Municipal Parks grant project was rebid and they were due May 23rd. He stated he was working on design plans, specifications and final construction estimate for Stewart Road/ Ivy Lane project. He noted the FY24 NJDOT grant applications are due July 1st.

SECTION 5. This Ordinance shall take effect after its final passage and publication according to law and shall be effective as of January 1, 2023 or date of hire or appointment if after January 1, 2023.

TOWNSHIP OF NORTH HANOVER
AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER AMENDING THE TOWNSHIP’S MUNICIPAL CODE FOR PURPOSES OF PROHIBITING THE IMPROPER DISPOSAL OF MATERIALS INTO THE MUNICIPAL STORM SEWER SYSTEM OPERATED BY THE TOWNSHIP OF NORTH HANVOER
SECTION 1. Purpose
An ordinance to prohibit the spilling, dumping, or disposal of materials other than stormwater to the municipal separate storm sewer system (MS4) operated by the Township of North Hanover, Burlington County, so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.
SECTION 2. Definitions
For the purpose of this ordinance, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this Chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.
a. Municipal separate storm sewer system (MS4)– a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, manmade channels, or storm drains) that is owned or operated by [insert name of municipality] or other public body, and is designed and used for collecting and conveying stormwater.
b. Person – any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
c. Stormwater – water resulting from precipitation (including rain and snow) that runs off the land’s surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.
SECTION 3. Prohibited Conduct
The spilling, dumping, or disposal of materials other than stormwater to the municipal separate storm sewer system operated by Township of North Hanover, Burlington County is prohibited. The spilling, dumping, or disposal of materials other than stormwater in such a manner as to cause the discharge of pollutants to the municipal separate storm sewer system is also prohibited.
SECTION 4. Exceptions to Prohibition
The following are exceptions to the prohibition:
a. Water line flushing and discharges from potable water sources.
b. Uncontaminated ground water (e.g., infiltration, crawl space or basement sump pumps, foundation or footing drains, rising ground waters).
c. Air conditioning condensate (excluding contact and non-contact cooling water).
d. Irrigation water (including landscape and lawn watering runoff).
e. Flows from springs, riparian habitats and wetlands, water reservoir discharges and diverted stream flows.
f. Residential car washing water, and residential swimming pool discharges.
g. Sidewalk, driveway and street wash water.
h. Flows from fire-fighting activities.
i. Flows from rinsing of the following equipment with clean water:
(i) Beach maintenance equipment immediately following their use for their intended purposes; and
(ii) Equipment used in the application of salt and de-icing materials immediately following salt and de-icing material applications. Prior to rinsing with clean water, all residual salt and de-icing materials must be removed from equipment and vehicles to the maximum extent practicable using dry cleaning methods (e.g., shoveling and sweeping). Recovered materials are to be returned to storage for reuse or properly discarded.
(iii) Rinsing of equipment, as noted in the above situation is limited to exterior, undercarriage, and exposed parts and does not apply to engines or other enclosed machinery.
SECTION 5. Enforcement
This ordinance shall be enforced by the Township Police Department and/or Zoning Officer of the Township of North Hanover, County of Burlington.
SECTION 6. Penalties
Any person(s) who continues to be in violation of the provisions of this ordinance, after being duly notified, shall be subject to the general penalties set forth in Section 1-035 of the Municipal Code of the Township of North Hanover.
SECTION 7. Severability
Each section, subsection, sentence, clause and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this Ordinance.
SECTION 8. Repealer
All provisions of any other ordinance which are inconsistent with the provisions of this Ordinance are hereby repealed.
SECTION 9. Effective date:
This Ordinance shall be in full force and effect from and after its adoption and any publication as may be required by law.

RESOLUTION SUPPORTING THE NEW JERSEY FOREST FIRE SERVICE AND
FUELS MITIGATION PROJECTS USING PRESCRIBED FIRE AND OTHER
TREATMENTS
WHEREAS, the New Jersey Forest Fire Service (hereinafter "Forest Fire Service"), a division of the Department of Environmental Protection, has been protecting the residents of this State from catastrophic wildfires since its inception in 1906; and
WHEREAS, wildfires pose a significant threat to human life and to improved Property within the Pinelands National Reserve; and
WHEREAS, the Forest Fire Service has had success mitigating the threats from wildfires using techniques such as prescribed fire and mechanical fuel reduction; and
WHEREAS, the Forest Fire Service recently contained a 11,129-acre wildfire in Washington, Shamong, and Hammonton Townships; 418-acre and 1607-acre wildfires along Route 539 in Little Egg Harbor Township; and a 257-acre wildfire in Washington Township; and
WHEREAS, the governing body desires to support the Forest Fire Service and its efforts in mitigating threats from wildfires using ongoing mitigation projects utilizing prescribed fire, mechanical fuel reduction, as well as the maintenance and construction of new and established fire breaks.
NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, County of Burlington, State of New Jersey as follows:
That the Township Committee supports the New Jersey Forest Fire Service and its efforts in mitigating threats from wildfires using ongoing mitigation projects, utilizing prescribed fire, mechanical fuel reduction, and the maintenance and construction of new and established fire breaks, which provide safety to the residents of the Township.
2) That a certified copy or this resolution shall be forwarded to New Jersey Department of
Environmental Protection, New Jersey Forest Fire Service and Governor Murphy.

2023-87 Resolution Accepting the Proposal from Environmental Resolutions Inc. Engineers for the Stormwater Pollution Prevention Plan Tier A Compliance

TOWNSHIP OF NORTH HANOVER
COUNTY OF BURLINGTON
RESOLUTION ACCEPTING THE PROPOSAL FROM ENVIRONMENTAL RESOLUTIONS INC. ENGINEERS FOR THE STORMWATER POLLUTION PREVENTION PLAN TIER A COMPLIANCE
WHERAS, Environmental Resolutions Inc. has submitted a proposal dated February 21, 2023 for engineering services for the Stormwater Pollution Prevention Plan Tier A Compliance ; and
WHEREAS, it is the desire of the Township Committee to accept the proposal from Environmental Resolutions Inc. Engineers for the Stormwater Pollution Prevention Plan Tier A Compliance , in an amount not to exceed $4,000.00; and
WHERAS, funds are available to accept said proposal, as evidenced by the attached Certification of Availability of Funds;
NOW, THEREFORE, BE IT RESOLVED, by the Township of North Hanover that it does hereby accept the proposal from Environmental Resolutions Inc. Engineers, in an amount not to exceed $4,000.00 to provide services for the Stormwater Pollution Prevention Plan Tier A Compliance.

2022-2023 Elected Officials Training – Clerk Picariello noted the changes in the training. She informed the Committee to check their emails for access to the training.

2023-88 Authorizing a Closed Session Meeting to discuss the following matter(s) pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 Court Personnel Matter, Contract Matter, Personnel and Litigation matters

TOWNSHIP OF NORTH HANOVER
COUNTY OF BURLINGTON
AUTHORIZING A CLOSED SESSION MEETING
WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and
WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.
NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Court Personnel Matter, Contract Matters, Litigation and Personnel matters.
BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
