CALL TO ORDER Mayor DeBaecke called the meeting to order at 7:00 p.m.

FLAG SALUTE: Led by Mayor DeBaecke followed by a moment of silence


INVOCATION: Mr. Wayne Voorhees offered thoughts and prayers for all governments and peaceful transitions of power, now that the elections are over. He lifted up the family of Mayor DeBaecke as they are dealing with a serious illness in their family. He asked for blessings for the Country, State and North Hanover Township.

ENGINEER’S REPORT

Engineer Hirsh was not present this evening but has submitted a written report. Clerk Picariello stated Engineer Hirsh was meeting with the public works contractor next week to discuss the stormwater permit requirements. She also stated the FY25 NJDOT grant applications are due January 31, 2025. The FY23 NJDOT project works was mostly complete and a pay estimate has been issued to the contractor. The FY24 NJDOT project pay estimated has been submitted to the Township for processing.

AN ORINANCE AMENDING ORDINANCE 2024-15 AMENDING ORDINANCE 2024-07 ENTITLED “AN ORDINANCE TO ESTABLISH SALARIES FOR VARIOUS OFFICIALS OF THE TOWNSHIP OF NORTH HANOVER, BURLINGTON COUNTY, STATE OF NEW JERSEY, AND REGULATING THE MANNER OF PAYMENT OF SAME” TO ESTABLISH NEW TITLES AND SALARY RANGES FOR NEW TITLES


NOW THEREFORE, BE IT ORDAINED by the Township Committee of the Township of North Hanover, that 2024-16 Amending 2024-15 Amending Ordinance 2024-07 entitled “An Ordinance To Establish Salaries For Various Officials Of The Township Of North Hanover, Burlington County, State of New Jersey, And Regulating The Manner of Payment of Same” be and is hereby amended to include certain new titles and salary ranges for said new titles as follows (additions are bolded and underlined):


SECTION 1. The annual rate (unless otherwise specified) of compensation, salary, wages of the following officers, appointees and employees of North Hanover Township is hereby fixed in the following schedule:

SECTION 5. This Ordinance shall take effect after its final passage and publication according to law and shall be effective as of September 1, 2024 or date of hire or appointment if after January 1, 2025.

AN ORDINANCE AMENDING ORDINANCE 2022-06 ENTITLED “AN ORDINANCE OF THE TOWNSHIP OF NORTH HANOVER, COUNTY OF BURLINGTON, STATE OF NEW JERSEY APPROPRIATING $150,000.00 FROM THE CAPITAL IMPROVEMENT FUND TO PROVIDE FOR VARIOUS CAPTIAL IMPROVEMENTS

BE IT ORDAINED by the Township Committee of the Township of North Hanover, in the County of Burlington, State of New Jersey, as follows:


SECTION 1. $150,000.00 is hereby appropriated from the Capital Improvement Fund of the Township of North Hanover, in the County of Burlington, New Jersey (the “Township”) to provide for various capital improvements and accessory equipment therefor and incidental thereto as follows:

Drainage Imp. and Engineering $ 40,000.00

Computer’s and related

Equipment $ 45,000.00

SECTION 2. Said acquisitions are lawful capital improvements of the Township having a period of usefulness of at least five (5) years. Said improvements and acquisitions shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited.


SECTION 3. This ordinance shall take effect upon final passage and publication according to law.

WHEREAS, the proposed North Hanover Realty Partners Urban Renewal LLC, located at Croshaw Road and McGuire Access Highway in the Township of North Hanover has made application to the New Jersey Department of Environmental Protection (“NJDEP”) for a Treatment Works Approval Permit concerning Block 602, Lot 9.02; and


WHEREAS, the Township Engineer has reviewed said application made by the owner North Hanover Realty Partners Urban Renewal LLC and has recommended execution of the same.


NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey that the Township Committee hereby consents to the proposed project and hereby authorizes the Township Engineer to execute the NJDEP Statements of Consent on behalf of the Township.

WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-36 authorizes the sale or other disposition of surplus municipal property no longer need for public use when authorized by resolution duly adopted by the governing body; and

WHEREAS, N.J.S.A. 40A:11-36 (6) further provides that if the estimated fair value of property to be sold does not exceed the applicable bid threshold in any one sale, the property may be sold at private sale without advertising for bids; and

WHEREAS, the Township Committee desires to dispose of said surplus property identified herein by way of private sale as the estimated fair value of same does not exceed the applicable bid threshold.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, in the County of Burlington, State of New Jersey that it does hereby authorize the disposal by way of private sale and without advertising for bids the following Township personal property no longer needed for public use because the estimated fair value of the property does not exceed the applicable bid threshold in any one sale:

WHEREAS, the Township of North Hanover (the ‘Township’) requires the replacement of the entrance vestibule doors at the Municipal Building and desires to install handicap accessible features to same, and


WHEREAS, the Township proceeded to solicit bids for the Municipal Building Vestibule Door Improvements project and received one (1) bid response as indicated on the attached Summary of Bids, with the low bid in the amount of $35,000.00 submitted by Garozza and Scimeca Construction Inc., and


WHEREAS, the lowest qualified bid is below the Engineer’s Estimate and submitted by a Contractor who has demonstrated experience completing similar work; and


WHEREAS, the Township Engineer has reviewed the submitted bids and recommended award of the contract to Garozza and Scimeca Construction Inc. in the amount of $35,000.00 via correspondence dated October 11, 2024, subject to the conditions contained therein,


Now, therefore, be it resolved by the Township Committee of the Township of North Hanover that the project known as the Municipal Building Vestibule Door Improvements project, is awarded to Garozza and Scimeca Construction Inc., in the amount of $35,000.00, subject to submission of required documentation.

A RESOLUTION AUTHORIZING PAY ESTIMATE NO. ONE TO ARAWAK PAVING COMPANY IN CONNECTION WITH THE NJDOT FY 2024 IVY LANE/CHESTNUT DRIVE IMPROVEMENT PROJECT


WHEREAS, the Township of North Hanover’s Engineers, Environmental Resolutions, Inc., has reviewed the Arawak Paving Company. Payment Certificate No. 1, representing payment in the total amount of $122,512.64, for the Ivy Lane/Chestnut Drive Road Improvement Project; and


WHEREAS, the Township's Engineer has determined that the condition of the improvement is satisfactory; and


WHEREAS, it is the recommendation of the Township’s Engineer that the Township of North Hanover authorize the release the payment on voucher in the total amount of $122,512.64 to Arawak Paving Company; and


WHEREAS, it is the intention of the Township Committee to approve the release of the payment on voucher in the amount referenced herein, in accordance with the Township Engineer’s recommendations.


NOW THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, that the Township authorizes the payment in the total amount of $122,512.64 to Arawak Paving Company.

BE IT FURTHER RESOLVED that copies of this resolution shall be provided to the Finance Director and the Township Engineer for their information and attention.

2024-175 Resolution Amending Resolution 2024-132 Approving Shared Services Agreement Between the Township of North Hanover and Township of New Hanover for Construction Code Related Services by Amending Certain Terms of Shared Services Agreement

RESOLUTION AMENDING RESOLUTION NO. 2024-132 APPROVING SHARED SERVICES AGREEMENT BETWEEN THE TOWNSHIP OF NORTH HANOVER AND TOWNSHIP OF NEW HANOVER FOR CONSTRUCTION CODE RELATED SERVICES BY AMENDING CERTAIN TERMS OF THE SHARED SERVICES AGREEMENT


WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., permits local units of this State to enter into shared services agreements with any other local unit for the joint provision within their combined jurisdictions of any service which any party to the agreement is empowered to provide within its own jurisdiction; and


WHEREAS, N.J.A.C. 5:25-4.6 authorizes two municipalities to administer and enforce the Construction Code services and the applicable regulations and sub-codes under the regulations; and


WHEREAS, the Township Committee of North Hanover Township previously adopted on August 15, 2024, Resolution No. 2024-132. Approving a Shared Services Agreement with the Township of New Hanover for the provisions of Construction Code services for New Hanover Township residents; and


WHEREAS, it is necessary to amend both Resolution No. 2024-132 and the Shared Services Agreement previously approved such that the term of the initial term of the agreement shall be four years, commencing September 1, 2024 and terminating on August 31, 2028; and


WHEREAS, New Hanover Township, Burlington County desires to contract with the North Hanover Township for the provision of such Construction Code services; and


WHEREAS, North Hanover Township is agreeable to providing those services to New Hanover Township, Burlington County, upon certain other specified conditions; and


WHEREAS, North Hanover Township and New Hanover Township, Burlington County, desire to execute a Shared Services Agreement, pursuant to the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-l et seq. as the agreement is in the best interest of North Hanover Township and New Hanover Township; and


WHEREAS, such agreements are authorized pursuant to the Uniform Shared Services Consolidation Act, N.J.S.A. 40A:65-1 et seq. and shall only become effective upon the adoption of a resolution by the governing body of each public entity authorizing and approving said agreement.


NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of North Hanover, in the County of Burlington, that it does hereby approve of the Shared Services Agreement Between the Township of North Hanover and the Township of New Hanover for Construction Code Related Services, a copy of which is on file in the Office of the Township Clerk and the Mayor and Township Clerk are authorized to execute said agreement on behalf of North Hanover Township.


BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to the Secretary for the New Hanover Township, Burlington County, Municipal Clerk Board of Education.

BE IT FURTHER RESOLVED that a copy of this resolution and agreement shall be forwarded to the Director of the Division of Local Government Services as per NJSA 40A:65-4 (3)b.

DISCUSSION





TOWNSHIP COMMITTEE “COMMENTS”

Committeeman Kocubinski stated the Tree lighting was scheduled for December 6th at 7pm and thanked the members for their work. He discussed the lack of membership and discussion was held regarding getting volunteers. There was a general consensus to allow recreational coaches fees, to be waived, for their children’s sports that they are coaching for. This would be an incentive to obtain coaches.


Committeeman Forsyth congratulated Committeeman Elect Palombi and Committeeman Elect Giberson on their election.


Committeeman Doyle also offered congratulations. He thanked Deputy Mayor O’Donnell and Committeeman Kocubinski for their hard work and years of bi-partisan relations. He noted we all worked well together. He noted Deputy Mayor O’Donnell’s hard work with Fire and EMS services. He noted Committeeman Kocubinski’ knowledge was unmatched.


Mayor DeBaecke noted the trunk or treat was well attended and went well. He thanked everyone for their work. He offered congratulations to the newly elected. He thanked Deputy Mayor O’Donnell and Committeeman Kocubinski for their hard work and noted he really enjoyed working with them.

Mayor DeBaecke opened the meeting to the public.


Mr. Harry Schultz inquired about the new doors and asked if it was handicapped accessible. He was told yes. He inquired about handicapped doors in the police department and access to the elevator. Clerk Picariello stated the elevator is in the stairwell and off limits to the public for liability issues. It was also noted the Police Department entrance is handicapped accessible. Committeeman Forsyth stated the front doors were rotting out. Mr. Schultz noted the trunk or treat was well attended and a lot of fun.

TOWNSHIP OF NORTH HANOVER

COUNTY OF BURLINGTON


AUTHORIZING A CLOSED SESSION MEETING


WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and


WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and


WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.


NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Police Department Personnel Matters, Contract Matters, Litigation and Personnel matters.


BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
